Standards for streams without established base flood elevation or floodways. <br />Within areas of special flood hazard, wherein streams exist for which no base flood data has <br />• been provided, or where no floodways have been identified, the following restrictions shall apply: <br />(1) No encroachments, including fill, new construction, substantial <br />improvements or new development, shall be permitted within a distance <br />of 20 feet on each side of the stream, from the top of its bank, unless <br />certification by a registered professional engineer is provided <br />demonstrating that such encroachments, when combined with other <br />previously placed of previously approved encroachments, will not <br />increase the water surface elevation of the base flood more than three fee <br />one foot at any point.
