(b)The city may anyly to the circuit court for the city of Charlottesville, to enjoin a violation or a <br />• threatened violation of the provisions of this article, without the necessity of showingthat hat an <br />adequate remedy at law exists. <br />(c)Without limiting the remedies that may be obtained pursuant to this section, the city may bring <br />a civil action against any person for violation of this article. The action may seek the imposition <br />of a civil penalty of not more than two thousand dollars ($2,000.00) against the person for each <br />violation. <br />d)With the consent of anv person who has violated or failed. neelected or refused to obev an <br />provision of this article, the program authority mayprovide, in an order issued by program <br />authority against such person, for the payment of a civil charge for any violation, in a specific <br />sum, not to exceed $2,000.00 per violation. Such civil charge shall be in lieu of anv civil penalty <br />which could be imposed under paragraph (C <br />ARTICLE V. STORM SEWER DISCHARGES <br />Sec. 10-91. Discharges to the city's storm sewer system. <br />(a)lt shall be unlawful and a violation of this article to: <br />(1).... <br />(2)Connect, or cause or allow to be connected, any sanitary sewer to the storm sewer <br />system, except any such connections owned or authorized by the city prior to September <br />• 20, 2004; <br />(3).... <br />(4).... <br />Sec. 10-92. Inspections and monitoring. <br />(a)The director, as defined in § 10-5 of this chapter, shall have authority to carry out all <br />inspection, surveillance and monitoring procedures necessary to determine compliance and <br />noncompliance with the provisions of this article, including the prohibition of illicit discharges to <br />the storm sewer system. The director may monitor stormwater outfalls or other components of the <br />municipal storm sewer system as may be appropriate in the administration and enforcement of <br />this article. <br />(b).... <br />Sec. 10-93.
