Revised November 10, 2005 <br />Prepared for Second Reading on November 21, 2005 <br />AN ORDINANCE TO AMEND CHAPTER 34 (ZONING) <br />OF THE CODE OF THE CITY OF CHARLOTTESVILLE (1990), <br />AS AMENDED, RELATING TO SPECIAL USE PERMITS, HEIGHT RESTRICTIONS <br />IN CERTAIN DISTRICTS, TEMPORARY SIGNS, AND MISCELLANEOUS CHANGES <br />. TO THE ZONING CHAPTER. <br />BE IT ORDAINED by the Council of the City of Charlottesville, Virginia, that Sections <br />34-157, 34-353, 34-984, 34-1045, 34-1101, 34-1120, and 34-1200 of the Charlottesville City <br />Code, 1990, as amended, are hereby amended and reordained, as follows: <br />ARTICLE 1. ADMINISTRATION <br />DIVISION 8. SPECIAL USE PERMITS <br />Sec. 34-157. General standards for issuance. <br />(a)In considering an application for a special use permit, the city council shall consider the <br />following factors: <br />• (1).... <br />(7)When the property that is the subject of the application for a special use permit is within a <br />design control district city council shall refer the application to the BAR or ERB as may be <br />applicable, for recommendations as to whether the proposed use will have an adverse impact on <br />the district and for recommendations as to reasonable conditions which if imposed, that would <br />mitigate any such impacts The BAR or ERB as applicable shall return a written report of its <br />recommendations to the city council <br />ARTICLE III. RESIDENTIAL DISTRICTS <br />DIVISION 2. REGULATIONS <br />Sec. 34-353. Dimensional requirements—by district. <br />(a)All buildings and structures shall be constructed within the area defined by the following <br />height, yard and land coverage requirements, according to the zoning district in which such <br />building or structure is located, as follows: <br />Zoning district Height restrictions <br />R-UMD 50 60 ft., max <br />• R-UHD 50 60 ft., max <br />
