Revised November 10, 2005 Prepared for Second Reading on November 21, 2005 AN ORDINANCE TO AMEND CHAPTER 34 (ZONING) OF THE CODE OF THE CITY OF CHARLOTTESVILLE (1990), AS AMENDED, RELATING TO SPECIAL USE PERMITS, HEIGHT RESTRICTIONS IN CERTAIN DISTRICTS, TEMPORARY SIGNS, AND MISCELLANEOUS CHANGES . TO THE ZONING CHAPTER. BE IT ORDAINED by the Council of the City of Charlottesville, Virginia, that Sections 34-157, 34-353, 34-984, 34-1045, 34-1101, 34-1120, and 34-1200 of the Charlottesville City Code, 1990, as amended, are hereby amended and reordained, as follows: ARTICLE 1. ADMINISTRATION DIVISION 8. SPECIAL USE PERMITS Sec. 34-157. General standards for issuance. (a)In considering an application for a special use permit, the city council shall consider the following factors: • (1).... (7)When the property that is the subject of the application for a special use permit is within a design control district city council shall refer the application to the BAR or ERB as may be applicable, for recommendations as to whether the proposed use will have an adverse impact on the district and for recommendations as to reasonable conditions which if imposed, that would mitigate any such impacts The BAR or ERB as applicable shall return a written report of its recommendations to the city council ARTICLE III. RESIDENTIAL DISTRICTS DIVISION 2. REGULATIONS Sec. 34-353. Dimensional requirements—by district.
