• AN ORDINANCE <br />AMENDING AND REENACTING THE ZONING DISTRICT MAP INCORPORATED <br />IN SECTION 34-1 OF THE ZONING ORDINANCE <br />OF THE CODE OF THE CITY OF CHARLOTTESVILLE, 1990, <br />(AS AMENDED) BY THE RE -ZONING OF PARCEL 373, CITY TAX MAP 59 <br />FROM "R -1S" TO "PUD" <br />WHEREAS, Moore's Creek Land, LLC ("Applicant") has made application for a rezoning of <br />Parcel 373, City Tax Map 59 ("Subject Property") from "R -1S" to "PUD" ("Proposed Rezoning") subject <br />to a PUD Development Plan dated October 27, 2005, and the narrative and other materials attached <br />thereto or referenced therein (together, "PUD Development Plan") submitted by the Applicant as part of <br />ZM-05-08-16; and <br />WHEREAS, ajoint public hearing on the Proposed Rezoning was held before the City Council <br />and Planning Commission on October 11, 2005, following notice to the public and to adjacent property <br />owners as required by law; and <br />WHEREAS, on October 11, 2005 the Planning Commission voted to recommend the Proposed <br />Rezoning; and <br />WHEREAS, this Council finds and determines that: <br />(1)The Proposed Rezoning is consistent with the Comprehensive Plan, and with the purpose and <br />intent of the Planned Unit Development District, as articulated within the City Code, Chapter 34, Article <br />• V; and <br />(2)The existing zoning and the proposed zoning district classification are both reasonable; and <br />(3)The public necessity, convenience, general welfare, or good zoning practice requires the <br />Proposed Rezoning. <br />Now, therefore, BE IT ORDAINED by the Council of the City of Charlottesville, Virginia that <br />the Zoning District Map Incorporated in Section 34-1 of the Zoning Ordinance of the Code of the City of <br />Charlottesville, 1990, as amended, be and hereby is amended and reenacted as follows: <br />Section 34-1. Zoning District Map. Rezoning from "R -IS" residential to Planned Unit <br />Development ("PUD") district all of the Property, consisting of approximately 2.19 acres <br />currently identified on City Tax Map 59 as Parcel 373, having approximately 54 feet of <br />frontage on Palatine Avenue, and approximately 550 feet of frontage along Avon Street, subject <br />to the following: all development must conform to the density, height and other dimensional <br />requirements, the general location of streets and other public improvements, the nature and <br />general location of uses, and the setbacks and other development conditions identified and <br />depicted within the PUD Development Plan. <br />Approved by Council <br />December 5, 2005 <br />• le c of City Council <br />
