AN ORDINANCE AMENDING AND REENACTING THE ZONING DISTRICT MAP <br />INCORPORATED IN SECTION 34-1 OF THE ZONING ORDINANCE <br />• OF THE CODE OF THE CITY OF CHARLOTTESVILLE, 1990, <br />AS AMENDED, BY THE RE -ZONING OF PROPERTY LOCATED AT <br />625 MONTICELLO ROAD FROM "R -1S RESIDENTIAL" TO "B-1 BUSINESS" <br />WHEREAS, the owner(s) of the property located at 702 and 709 Sonoma Street, and 625 <br />Monticello Road, identified on City Tax Map 57 as Parcels 92, 94 and 95, respectively, through <br />their authorized representative, Mary F. Hunter ("Applicant"), submitted an application seeking a <br />rezoning of such property from the "R-1 S" Residential district to the `B -I" Business district, <br />subject to proffered development conditions (hereinafter, the "Proposed Rezoning"); and <br />WHEREAS, a joint public hearing on the Proposed Rezoning was held before the City <br />Council and Planning Commission on October 11, 2005, following notice to the public and to <br />adjacent property owners as required by law; and <br />WHEREAS, on October 11, 2005 the Planning Commission voted to recommend approval <br />of the Proposed Rezoning to the City Council, subject to the development conditions set forth <br />within the applicant's Preliminary Proffer Statement; and <br />WHEREAS, the applicant has prepared a Final Proffer Statement, dated October 19, 2005, <br />as required by §34-64(c), and the Final Proffer Statement has been submitted and made a part of <br />these proceedings; and <br />• WHEREAS, the Proposed Rezoning was considered by City Council on November 21, <br />2005, and amended on second reading of the Ordinance on December 5, 2005, by removing the <br />properties designated as 702 Sonoma Street and 709 Sonoma Street from the Proposed Rezoning; <br />and <br />WHEREAS, this Council finds and determines that the public necessity, convenience, <br />general welfare or good zoning practice requires the Proposed Rezoning, as amended by Council at <br />its meeting on December 5, 2005; that both the existing "R -1S" Residential district and the <br />proposed `B-1" Business district (subject to proffered development conditions) zoning <br />classifications are reasonable; that the Proposed Rezoning, as amended, is consistent with the <br />Comprehensive Plan; Now, therefore, <br />BE IT ORDAINED by the Council of the City of Charlottesville, Virginia that the Zoning <br />District Map Incorporated in Section 34-1 of the Zoning Ordinance of the Code of the City of <br />Charlottesville, 1990, as amended, be and hereby is amended and reenacted as follows: <br />Section 34-1. Zoning District Map. Rezoning from "R -1S" Residential to `B-1" Business, <br />subject to the proffered development conditions set forth within the Final Proffer Statement <br />dated October 19, 2005, revised through December 5, 2005, all of the property located at 625 <br />Monticello Road, identified on City Tax Map 57 as Parcel 95, consisting of approximately <br />0.129 acre with approximately 30 feet of frontage along Monticello Road. <br />Approved by Council C—,a5-J <br />• December 5, 2005 C(erk of City Council <br />
