Prepared Sept. 16, 2005 by City Attorney's Office <br />• AN ORDINANCE TO REPEAL §§15-36 THROUGH 15-51, and §15-134 OF <br />CHAPTER 15, OF THE CHARLOTTESVILLE CITY CODE, 1990, AS <br />AMENDED, TO ELIMINATE THE REQUIREMENT OF A CITY VEHICLE <br />DECAL; TO AMEND AND RE-ENACT CHAPTER 15, ARTICLE II, TO <br />IMPOSE A LICENSE AND LICENSE FEE UPON CERTAIN MOTOR <br />VEHICLES, TRAILERS, SEMITRAILERS AND MOPEDS; AND TO AMEND <br />RELATED PROVISIONS SET FORTH WITHIN §§ 15-52,15-131,15-149,15-251, <br />15-271 AND 30-35 OF THE CHARLOTTESVILLE CITY CODE, 1990, AS <br />AMENDED. <br />WHEREAS, by authority of §46.2-752 of the Code of Virginia (1950), as <br />amended, the City of Charlottesville may impose license fees on motor vehicles, trailers <br />and semitrailers, in such manner, on such basis, and for such periods, and subject to <br />proration for fractional periods of years, as this City Council may determine; and <br />WHEREAS, pursuant to Virginia Code §46.2-752 this City Council desires to <br />impose a local license fee on motor vehicles, trailers and semitrailers, without requiring <br />any local decal to be obtained or displayed thereon; <br />NOW, THEREFORE, BE IT ORDAINED that: <br />• 1. Chapter 15 (Motor Vehicles and Traffic), Sections 15-36 through 15-51, and Section <br />15-134 of the Charlottesville City Code, 1990, as amended, are hereby repealed, in their <br />entirety; and <br />• <br />2. Chapter 15 and Chapter 30, are hereby amended and reordained, by adding new <br />sections numbered 15-36 through 15-39, and amending Sections 15-131, 15-149, 15-251, <br />15-271, and Sec. 30-35, all to read as follows: <br />CHAPTER 15. MOTOR VEHICLES AND TRAFFIC <br />See. 15-36. License required. <br />a) Subiect vehicles. For each and every calendar year, every person who owns or leases <br />any motor vehicle trailer or semitrailer that is normally garaged, stored or parked within <br />the city shall annually obtain a city license for such motor vehicle, trailer or semitrailer. If <br />persons administering the provisions of this ordinance cannot determine where such <br />motor vehicle is normally garaged stored or parked, then such person shall be required to <br />obtain a city license for the motor vehicle trailer or semitrailer if he is a domiciliary of <br />the city of Charlottesville <br />(b)Grace period The owner of the subject motor vehicle, trailer or semitrailer shall <br />contact the city treasurer for the license(s) required by this section within thirty (30) days <br />Page I of 6 <br />
