FOR SECOND READING —December 5, 2005 <br />Revised November 29, 2005 <br />AN ORDINANCE TO AMEND CHAPTER 28 OF THE CODE OF THE <br />CITY OF CHARLOTTESVILLE (1990), AS AMENDED, TO <br />REVISE REGULATIONS APPLICABLE TO STREET VENDORS <br />AND THE OPERATION OF OUTDOOR CAFES <br />BE IT ORDAINED by the Council of the City of Charlottesville, Virginia, that Sections 28-2, <br />28-30,28-112,28-116,28-119,28-121,28-211,28-212,28-213,28-214 and 28-216, of the <br />Charlottesville City Code, 1990, as amended, are hereby amended and reordained, as follows: <br />ARTICLE I. IN GENERAL <br />Sec. 28-2. Definitions. of "streets." <br />(a) The term "streets," when used in this chapter, shall mean public streets, sidewalks, walkways, alleys, <br />lanes and highways of the city, except where by the context or by reasonable intent sidewalks or <br />walkways are not included. <br />(b) For the purposes of this aAiek-chapter, the term "Downtown Pedestrian Mall" shall mean and refer to <br />the brick -paved area of Main Street, bounded by Ridge -McIntire Road on the west and 7th Street, S.E. on <br />the east. The Downtown Pedestrian Mall shall be designated on a map approved by the city manager and <br />• maintained available for public inspection within the city's department of neighborhood development <br />services. <br />c) For the nurooses of this chaoter, the term "fire lane" shall have the same meaning as the term "fire <br />apparatus access road," as defined within the Virginia Statewide Fire Prevention Code. With respect to <br />the downtown mall and the side streets leading to the downtown mall, fire lanes shall be designated on a <br />mat) anoroved by the citv's fire official and maintained available for public inspection within the city's <br />department of neighborhood development services <br />d) The term "pedestrian walkwav" when used in this chaoter, shall mean an area improved for public <br />pedestrian travel, such as a sidewalk. With respect to the Downtown Pedestrian Mall, all areas designated <br />and reserved for public pedestrian travel shall be designated on a map approved by the city manager and <br />maintained available for Dublic inspection within the citv's department of neighborhood develot)ment <br />services <br />Sec. 28-30. Restricted use of city streets. <br />No activity conducted by any person in or upon any city streets or rights-of-way shall be located where <br />such activity: <br />(1) Would block access to the entrance to any adjacent building or driveway; <br />(2) Would occupy more than half of the ..vaiiati <br />n�a �hidewa'„ width of any pedestrian <br />walkway. or would obstruct the free and orderlv flow of pedestrian traffic within an <br />pedestrian walkway; <br />• <br />
