Ah Sec. 34-1052. Park t;eet North Downtown, Wertland Street and Ridge Street architectural design <br />districts—special regulations. <br />(a)ln addition to other applicable regulations set forth in this article, the following regulations shall apply to <br />establishments located within the Faajer Elesign een4el districts applieable to Park Street and RidgeStrce <br />North Downtown, Wertland Street and Ridge Street architectural design control districts (reference -See -§34- <br />272), except as approved with an optional comprehensive sign plan:.... <br />Sec. 34-1101. Appurtenances. <br />(a).... <br />(b) .... <br />(c)No rooftop appurtenance shall: (i) itself have any tiseable flOOF area (exee.t r - _ eolianioal e,.,.:..men <br />installations), (ii) itself measure more than 16 feet in height above the building, or (iii) ii cover more than <br />25% of the roof area of a building. A roof -top appurtenance may contain useable floor area, but such area <br />may only be used for or as an accessory to a residential or commercial use allowed within the applicable <br />zoning district. <br />(d) .... <br />See. 34-1104. Compliance with building code. <br />(a)No building or structure shall be used or occupied except in accordance with a valid certificate of <br />occupancy issued by the city's building code official. <br />Upon receipt of a zoning application proposing a change in use of the property, the emplovee or <br />official receiving the application shall forward it to the city's building code official for review. <br />• The building code official will determine whether the property in question has previously been <br />issued a certificate of occupancy and whether any certificate of occupancy or equivalent <br />approval is required by the state building code. <br />(2) The zoning administrator's signature on a certificate of occupancy shall constitute his certification <br />that the use that is the subject of the certificate is lawful under the provisions of the city's zoning <br />ordinance. <br />(b)Within any development containing more than one (1) building or structure, where any buildings or <br />structure have been completed, and are ready for occupancy, prior to the completion of all of the <br />improvements required by the approved site plan for the development, the owner may provide a bond with <br />surety adequate to guarantee the completion of the remaining improvements by a date certain. Upon the <br />provision of such bond, and upon payment of any fee required by the most recent fee schedule adopted by <br />City council, then a certificate of occupancy may be issued by the city's building code official to allow <br />occupancy of buildings or structures already completed.... <br />Sec. 34-1123. Lot area requirements certain residential uses. <br />When located on a lot containing fewer than three (3) total dwelling units, and where permitted within the <br />applicable zoning district, the following residential uses shall be subject to the specified minimum (min.) and <br />average (avg.) lot area requirements, according to the zoning district in which such uses are located: <br />14- <br />Single-family <br />detached (SFD) <br />Single-family <br />attached (SFA) <br />Two-family (TFD) Townhouse (TH) <br />R-1 <br />8,125 SF min. <br />NA <br />NA NA <br />R -IS <br />6,000 SF min. <br />NA <br />NA NA <br />14- <br />
