(2) Only persons holding valid certificates of appropriateness issued pursuant to 828-119 <br />• may utilize an assigned vendor space on the Downtown Pedestrian Mall. <br />(3) Use of all vendor stand spaces shall be in accordance with the requirements of this <br />section and all other requirements of this article. <br />See. 28-119. Certificate of appropriateness for stands. <br />(a) No vendor stand may be located or operated within a major architectural design control district, as <br />defined within section 34-272 of the City Code, until it has been issued a certificate of appropriateness <br />pursuant to this section. No certificate of appropriateness shall be required for a stand that is leeated <br />within five (5) feet of the f�ieaile of a building on whielt the vendef maiiitains a plaee of business lieen <br />L.., the OF c . a ,.ta...d operated by a city market vendor pursuant to Chapter 8 of the City Code; <br />however such stands shall otherwise be required to comply with the regulations and requirements set forth <br />within this article governing the size, appearance and operational restrictions applicable to vendor stands. <br />Addition of features or accessories not specifically approved as part of a current certificate of <br />appropriateness for a vendor stand shall constitute a violation of this section. <br />(b) Application for a certificate of appropriateness shall be submitted to the city's zoning administrator, <br />and the zoning administrator shall conduct an administrative review of the application. The application <br />shall identify the size of the proposed stand and shall include graphic or other descriptions of the nature <br />and characteristics of the stand. The zoning administrator shall approve or deny a certificate of <br />appropriateness regarding a proposed stand based upon consideration of the requirements and criteria <br />established in this article and within the city's design guidelines for vendor stands. Upon approval of an <br />• application the zoning administrator shall issue the approved certificate of appropriateness following <br />receipt of the fee specified in par-.,.-... h (g below the most recent fee schedule approved by city council. <br />If the application is denied, the zoning administrator shall mail or hand -deliver written notice of that <br />decision to the applicant, which notice shall set forth the specific reason(s) for the denial with reference to <br />specific ordinances, laws or regulations.
