BEFORE THE CITY COUNCIL OF THE CITY OF CHARLOTTESVILLE, VIRGINIA <br />• IN RE: PETITION FOR REZONING PARCELS (CITY APPLICATION NO. -05- -1 <br />FROM R-2 AND M -I TO MIXED USE PLANNED UNIT DEVELOPMENT (PUD) <br />STATEMENT OF DEVELOPMENT PLAN <br />DATED February41, 2006 <br />TO THE HONORABLE MAYOR, MEMBERS OF THE COUNCIL OF THE CITY OF <br />CHARLOTTESVILLE, CHAIR AND MEMBERS OF THE PLANNING COMMISSION OF <br />THE CITY OF CHARLOTTESVILLE <br />The undersigned applicant is the owner of land subject to the above rezoning petition. The <br />land is designated on City Tax Maps as TM #57, Parcel 161,162, 163, 164, 165, and 165. 1, and <br />is approximately 1.01 acres in size. Title to the property is in the name of Carlton Property, LLC. <br />The applicant sets forth its Development Plan as shown on "Eddins Cottages" concept plan <br />prepared by The Gaines Group dated October 25, 2005 and with a revision date of January 27, <br />2006, and "Carlton Commercial Center" of Gloeckner Engineering/Surveying Inc., dated March <br />13, 2002, a site plan that was approved by the City in 2002, by attachment. Reference is hereby <br />made to drawings shown on these documents. <br />1. The plan describes and depicts the entire land area to be included within the PUD <br />Development. The PUD combines parcels with different zonings to bring some coherence to <br />development in the area. One parcel (hereafter referred to as "Commercial Component"), is <br />• presently zoned M-1 and includes .62 acres, about 10,008.5 square feet of which is the footprint <br />of a commercial structure. It is depicted as TM57, parcels 161, 162, 163, and 164 and is shown <br />as the "Carlton Commercial Center" on the Gloeckner Survey dated March 13, 2002. This site <br />plan was approved by the City in 2002. There is no plan to alter the present uses on this portion <br />of the site and the zoning will be limited to those allowed in B2. <br />The second set of properties is zoned R-2 and is presently residential in character (hereafter <br />referred to as "Residential Component"). The properties include all of TM 57, parcels 161,165, <br />165.1 and 164 located at the corner of Chestnut Street and Carlton Avenue, as shown on the <br />Gaines Group drawings. The property immediately to the east of the Residential Component is <br />the Commercial Component owned by the applicant. The property immediately to the north is <br />owned by Frederick Schmidt and Vivian Jones, who reside at the property located at 312 <br />Chestnut Street. The existing zoning classification of this property is R-2. Said zoning <br />classification permits, by right, 4 detached units or 8 attached units. The applicant proposes 10 <br />units for the site; 6 are detached and 4 are attached. <br />2. The proposed development of the Residential Component will be a clustered development <br />of single-family units that will range in size from 2,100 sq. feet for Units 1 and 2, 1,800 sq. feet <br />for 3, 4, 5 and 6, and approximately 1,300 sq. feet for Units 7-10. Each unit, except for Unit 6, <br />will have a garage. Parking for all units will be located on site. All units will be constructed <br />according to styles as shown on the Gaines Group Development Plan. The applicant will prepare <br />and record a Declaration of Covenants and Restrictions to ensure that the development is <br />properly maintained through the creation of a homeowner's association.
