t <br />RESOLUTION GRANTING -SPECIAL PERMITS <br />FOR PROPERTY- LOCATED IN THE <br />BLOCK BO•UNDED`BY <br />JEFFERSON, THIRD, HIGH AND SECOND. STREETS, N. E. <br />WHEREAS, CF Corpora tiorr.ha's',applied,for special permits for several. aspects <br />of a proposed high density residential and commercial development for the property <br />comprising the city block bounded,by-Jefferson, Third,'High and Second Streets,-N.E.; <br />and <br />WHEREAS, such application has been duly advertised, and has been the '. <br />subject of public hearings jointly,conducted' by this Council and'the City Planning.. <br />Commission, and of review aria comment by:the."Board of Architectural Review; all <br />as provided by law; and. <br />WHEREAS, the granting of such special permits has been recommended to <br />Council by the Planning Commission; now,- therefore, be it <br />RESOLVED by the.Council of the City of Charlottesville, Virginia, that: <br />I. A special permit is hereby granted pursuant to §31-33 of the <br />City,Code, for development of such property at a maximum residential <br />density of 91 units, or 87 units per acre. The Council .finds and <br />declares that the proposed project is. in compliance with <br />the standards and requiremerits for'such residential higher density <br />special permits set forth in §31-33; and this permit is hereby <br />expressly conditioned upon development of the property in conformity <br />with such standards and conditions. <br />2. A further special permit is hereby granted pursuant to §317140.1 <br />of the City Code for the proposed building to be constructed on such <br />property to a maximum height of seventy-five feet from grade to <br />cornice line. The Council hereby finds and declares that the height <br />of such proposed building is .appropriate to such location', does not <br />have undue adverse impact on the seale and architectural harmony b <br />..the Architectural. Design Control District, and permits adequate' <br />sunlight and open.air on the adjacent streets. The Council further .' <br />finds that the proposed location andidesign'of..sucli. kbuildind and the <br />procedures by which it`has been considered substantially conform.to <br />the other requirements of such §31-140.1,_and the granting of this <br />permit is;hereby expressly conditioned upon construction of the <br />project in substantial conformity therewith. <br />
