3,. Pursuant to §31-228.1 of the City Code, modifications are <br />• hereby granted to the required front and rear yard setbacks normally <br />applicable in B-1 Business Districts. As,applied to the subject <br />property such -modifications shall be a reduction of, fifteen feet in <br />the customary setback for the front yard (High Street. side) and a <br />reduction of twenty, feet in the customary setback' for the rear yard <br />.(Jefferson Street side). The Council finds and declares that such <br />modifications are in harmony with the purposes and intents 'of <br />Articles IV, IX, XVI and XX -,of Chapter 31 of the City Code, under <br />which the foregoing special permits and modifications; are being <br />sought, and further finds and declares that such modifications are <br />necessary and desirable iri view of the nature, circumstances, <br />location and situation of the project proposed for such properfy'. > Such modifications are hereby imposed as specific conditions of <br />the foregoing., special permits, and the project shall be developed <br />in full conformity therewith, s <br />.4.. The Council further finds and declares that the application. for. <br />the aforesaid special permits substantially conforms to the <br />standards, conditions andproceduresestablished for special <br />permits generally by Article XX (Sec. 31-218 et seq.) 'of Chapter <br />31 of the City Code. The granting of such special permits and <br />modifications is hereby conditioned upon execution of the <br />• proposed project in full' compliance with such article; as well as ' <br />with all other applicable city ordinances and state or federal law. <br />5. The 'following special conditions shall also -be applicable to <br />the granting of such special,permits and modifications..''.. <br />(a) The property shall be.developed in substantial conformity. , <br />with the basic site plan as .preliminary approved by the Planning <br />Commission on January 9, 1979. Thegommission shall be <br />responsible. -for finalireview and approval of such site plan <br />following submission by the -applicant of detailed plans for: <br />(i) Final landscaping details of the courtyard or plaza area <br />and other exterior open spaces; <br />(ii) location -,,,character, -size, height and orientation of ` <br />proposed signs;. and <br />(iii) location, nature, intensity, and directional character- <br />istics of all exterior lighting" fixtures. <br />(b) The applicant"sha'll submiefor approval by the Director of <br />Planning, locations, dimensions and descriptions of recreational <br />spaces and amenities yequired under City Code §31-34. . <br />
