• A RESOLUTION <br />GRANTING A SPECIAL PERMIT FOR THE USE <br />OF PROPERTY LOCATED AT 2025 IVY ROAD <br />AS A RESTAURANT WITH DRIVE-IN WINDOW. <br />WHEREAS, Hardees Food Systems,- Incorporated has applied for <br />a special permit to'use property owned by it located at 2025 Ivy Road in <br />a B-2 Business District to expand the existing restaurant on the property <br />and install a drive-in window; and <br />WHEREAS, such application has been duly advertised as provided <br />by law, and has been the subject of a public hearing jointly held by this <br />Council and the City Planning Commission on June 12, 1979; and <br />WHEREAS, the City Planning Commission has recommended <br />approval of such special permit, now, therefore, be it <br />RESOLVED by the Council of the City of Charlottesville, Virginia, <br />that: <br />• (1) The property located in a B-2 Business District at 2025 Ivy <br />Road, designated as Parcel 2.1 on City Real Property Tax Map 7, is <br />hereby granted a special permit for use as a drive-in restaurant, as <br />permitted under §31-86 of the City Code. <br />(2) The Council finds that such use conforms to the requirements <br />for special permits generally imposed by Article XX (§31-218 et seq.) of <br />Chapter 31 of the City Code, and this permit is subject to all conditions <br />and restrictions imposed generally by such article. <br />(3) Such special permit shall be limited to that portion of the <br />aforesaid property designated for such use on the site plan submitted with <br />the special permitapplication, and shalt further be conditioned upon <br />development of the property in accordance with such site plan, as <br />conditioned by the Planning Commission, and finally approved by the <br />Director of Planning. <br />(4) Such special permit shall further be conditioned upon the <br />shielding of existing and proposed exterior lighting on such property and <br />the planting of not less than four trees in the existing planting islands at <br />the front of such property, in order to minimize glare, noise and visual <br />impact on.the adjacent residential area to the south of Ivy Road. <br />0 <br />
