• • 0 Copy teste: Clerk of Council Adopted by Council :-lay 18, 1981 RESOLUTION GRANTING A SPECIAL PERMIT FOR THE USE OF PROPERTY LOCATED AT 2025 IVY ROAD AS A DRIVE-IN RESTAURANT WHEREAS, Boddie-Noell Enterprises, Inc. has applied for a special permit to use property owned by it and located at 2025 Ivy Road' in a B-2 Business District as a drive-in restaurant; and WHEREAS, such application has been duly advertised as provided by law and has been the subject of public hearings before the City Planning Commission on April 14, 1981 and before this Council on May 4, 1981; and WHEREAS, the City Planning Commission has recommended approval of such special permit; now, therefore, be it RESOLVED by the Council of the•City ofCharlottesville, Virginia, that: N 1. That portion of City Real Property Tax Map Parcel 7-2.1, presently located in a B-2 Business District, at 2025 Ivy Road, is hereby granted a special permit for use as a drive-in restaurant as permitted under §31-86 of the City Code:, 2. The Council -finds that such use confrms to the require- ments for special permits generally imposed by Article XX (531-218 et,seq.) of Chapter'31 of the City Code, and this permit is subect to all conditions and restrictions imposed generally by such article. 3. Such special permit shall be conditioned upon develop- ment of the property in accordance with the site plan, as conditioned by the Planning Commission and finally approved by the Director of Planning. 4. That additional screening be provided along the street frontage of the property to help minimize visual impact from the restaurant and automobiles in the parking lot,. on the residential area across the street. 5'. That alterations to the existing ventilation system of the .restaurant be made in accordance with the petitioners' letter to the Department of Community Development dated May 8, 1981.
