• <br />• <br />0 <br />Copy teste: <br />Clerk of Council <br />Adopted by Council <br />:-lay 18, 1981 <br />RESOLUTION <br />GRANTING A SPECIAL PERMIT <br />FOR THE USE OF PROPERTY LOCATED AT <br />2025 IVY ROAD <br />AS A DRIVE-IN RESTAURANT <br />WHEREAS, Boddie-Noell Enterprises, Inc. has applied for a <br />special permit to use property owned by it and located at 2025 <br />Ivy Road' in a B-2 Business District as a drive-in restaurant; <br />and <br />WHEREAS, such application has been duly advertised as <br />provided by law and has been the subject of public hearings <br />before the City Planning Commission on April 14, 1981 and <br />before this Council on May 4, 1981; and <br />WHEREAS, the City Planning Commission has recommended <br />approval of such special permit; now, therefore, be it <br />RESOLVED by the Council of the•City ofCharlottesville, <br />Virginia, that: <br />N <br />1. That portion of City Real Property Tax Map Parcel <br />7-2.1, presently located in a B-2 Business District, <br />at 2025 Ivy Road, is hereby granted a special permit <br />for use as a drive-in restaurant as permitted under <br />§31-86 of the City Code:, <br />2. The Council -finds that such use confrms to the require- <br />ments for special permits generally imposed by Article <br />XX (531-218 et,seq.) of Chapter'31 of the City Code, <br />and this permit is subect to all conditions and <br />restrictions imposed generally by such article. <br />3. Such special permit shall be conditioned upon develop- <br />ment of the property in accordance with the site plan, <br />as conditioned by the Planning Commission and finally <br />approved by the Director of Planning. <br />4. That additional screening be provided along the street <br />frontage of the property to help minimize visual impact <br />from the restaurant and automobiles in the parking lot,. <br />on the residential area across the street. <br />5'. That alterations to the existing ventilation system of <br />the .restaurant be made in accordance with the petitioners' <br />letter to the Department of Community Development dated <br />May 8, 1981. <br />
