• RESOLUTION GRANTING SPECIAL USE PERMIT <br />TO CHARLOTTESVILLE AREA FAMILY YMCA <br />FOR THE OPERATION OF A PRIVATE, NONCOMMERCIAL <br />RECREATIONAL FACILITY AND A DAYCARE FACILITY <br />ON PROPERTY LOCATED AT 1025 PARK STREET AND U.S. ROUTE 250 BYPASS <br />WHEREAS, the Charlottesville Area Family YMCA has applied for <br />a special use permit to locate its recreational facilities and <br />child daycare center on property located at 1025 Park Street and <br />the U.S. Route 250 Bypass, formerly the site of Heritage Christian <br />School and Rock Hill Academy, further identified on City Real <br />Property Tax Map #45 as Parcel 2, and on Tax Map #47 as Parcel 10, <br />having 70 feet of frontage on Park Street, 626 feet of frontage on <br />U.S. Route 250 Bypass, and containing approximately 7.89 acres of <br />land; and <br />WHEREAS, following a joint public hearing before this Council <br />and the Planning Commission, duly advertised and held on August <br />11, 1987, this Council finds that such uses will conform to the <br />standards set forth in Section 31-220 of the City Code and to the <br />criteria applicable to special permits generally under Chapter 31 <br />• of the City Code; now, therefore <br />BE IT RESOLVED by the Council of the City of Charlottesville, <br />Virginia that a special use permit is hereby granted pursuant to <br />City Code Sections 31-14(c) and 31-14(e) to operate a private, <br />noncommercial recreational facility for group use and a child <br />daycare facility on the aforesaid property. Such special permit <br />shall be subject to the conditions imposed by the City zoning <br />ordinance upon special permits generally and shall further be <br />subject to the following special conditions: <br />1) That the daycare facility be limited to a maximum <br />enrollment of 75 children. <br />2) That the YMCA submit and obtain administrative approval <br />of a final site plan and soil erosion and sediment control plan <br />prior to occupancy of the site. <br />3) That the site plan show a redesigned entrance and exit <br />at the Route 250 Bypass westbound access ramp to permit right <br />turns only into and out of the property at that location. <br />4) That the site plan show the location of 108 required <br />parking spaces on the site. <br />5) That prior to occupancy the YMCA post a bond or other <br />• financial guarantee acceptable to the City Attorney for 100% of <br />the estimated cost of all incomplete required site plan improve- <br />ments, including the redesigned access road and the full 108 <br />parking spaces. Such guarantee shall remain in effect for two <br />
