• RESOLUTION AMENDING SPECIAL USE PERMIT <br />GRANTED TO COVENANT SCHOOL TO ALLOW OPERATION <br />OF A PRIVATE SCHOOL FACILITY <br />AT THE FORMER MCINTIRE SCHOOL BUILDING <br />WHEREAS, the Covenant School has requested a further <br />amendment to its special use permit originally granted May 20, <br />1985 and extended and amended November 3, 1986 and May 4, 1987 to <br />allow expansion of its school operations into the entire McIntire <br />School building and site on the U.S. Route 250 Bypass at Birdwood <br />Road; and <br />WHEREAS, following a joint public hearing before this Council <br />and the Planning Commission, duly advertised and held on August 11, <br />1987, this Council finds that such use will conform to the <br />standards set forth in Section 31-220 of the City Code and to the <br />criteria applicable to special permits generally under Chapter 31 <br />of the City Code; now, therefore <br />BE IT RESOLVED by the Council of the City of Charlottesville, <br />Virginia that the special use permit originally granted May 20, <br />1985 and extended and amended November 3, 1986 and May 4, 1987 is <br />further amended to allow the Covenant School to operate a private <br />school facility on the entire McIntire School site. Such property <br />• is further identified on City Real Property Tax Map #45 as Parcel <br />7, having approximately 430 feet of frontage on the U.S. Route 250 <br />Bypass, 570 feet of frontage on Birdwood Road, 590 feet of <br />frontage on Edgehill Road, and 600 feet of frontage on Hillcrest <br />Road, and containing approximately 315,500 square feet of land or <br />7.24 acres. <br />This special use permit, as amended, is conditioned upon <br />continued compliance with the requirements for special permits <br />generally set forth in Chapter 31 of the City Code and upon the <br />following special conditions and limitations: <br />1) Student enrollment in the school shall be limited to a <br />maximum of 300. <br />2) No outdoor interscholastic athletic activities shall be <br />permitted on the site. <br />3) No daycare or afterschool care program shall be conducted <br />on the site without further amendment of this special permit. <br />4) The Covenant School shall submit and obtain administrative <br />approval of a completed site plan, including all measures <br />recommended by the City Planning Commission and shall post a full <br />performance bond or other financial guarantee acceptable to the <br />City Attorney before obtaining a temporary certificate of <br />is <br />occupancy and occupying the premises for the 1987-88 school year. <br />
