• RESOLUTION AMENDING SPECIAL USE PERMIT GRANTED TO COVENANT SCHOOL TO ALLOW OPERATION OF A PRIVATE SCHOOL FACILITY AT THE FORMER MCINTIRE SCHOOL BUILDING WHEREAS, the Covenant School has requested a further amendment to its special use permit originally granted May 20, 1985 and extended and amended November 3, 1986 and May 4, 1987 to allow expansion of its school operations into the entire McIntire School building and site on the U.S. Route 250 Bypass at Birdwood Road; and WHEREAS, following a joint public hearing before this Council and the Planning Commission, duly advertised and held on August 11, 1987, this Council finds that such use will conform to the standards set forth in Section 31-220 of the City Code and to the criteria applicable to special permits generally under Chapter 31 of the City Code; now, therefore BE IT RESOLVED by the Council of the City of Charlottesville, Virginia that the special use permit originally granted May 20, 1985 and extended and amended November 3, 1986 and May 4, 1987 is further amended to allow the Covenant School to operate a private school facility on the entire McIntire School site. Such property • is further identified on City Real Property Tax Map #45 as Parcel 7, having approximately 430 feet of frontage on the U.S. Route 250 Bypass, 570 feet of frontage on Birdwood Road, 590 feet of frontage on Edgehill Road, and 600 feet of frontage on Hillcrest Road, and containing approximately 315,500 square feet of land or 7.24 acres. This special use permit, as amended, is conditioned upon continued compliance with the requirements for special permits generally set forth in Chapter 31 of the City Code and upon the following special conditions and limitations: 1) Student enrollment in the school shall be limited to a maximum of 300. 2) No outdoor interscholastic athletic activities shall be permitted on the site. 3) No daycare or afterschool care program shall be conducted on the site without further amendment of this special permit. 4) The Covenant School shall submit and obtain administrative approval of a completed site plan, including all measures recommended by the City Planning Commission and shall post a full performance bond or other financial guarantee acceptable to the City Attorney before obtaining a temporary certificate of is occupancy and occupying the premises for the 1987-88 school year.
