Huja, Director <br />City of Charlottesville <br />Department of Planning and <br />Community Development <br />City Hall <br />605 East Main Street <br />Charlottesville, VA 22901 <br />Re: Sigma Alpha Mu (Beta Psi Housing Corporation, 619 Cabell Avenue) <br />Dear Mr. Huja: <br />In response to the recommendation of the Planning Commission that our <br />• Special Permit and Site Plan be approved subject to the condition that the <br />existing side porch and garage be retained, and to the concerns raised by <br />Mr. Towe at the July 6 City Council meeting, we propose that the following <br />notes be added to the site plan to provide the additional control deemed <br />necessary by Mr. Towe: <br />1. Existing side porch and garage to remain. <br />2. Existing garage to be repaired and modified to provide one <br />(1) parking space and a storage area. <br />3. Property and improvements thereon to be brought into substantial <br />compliance with applicable building, housing and other health and <br />safety codes, ordinances and regulations prior to the issuance of a <br />permanent occupancy permit. ) <br />At the July 6 meeting, the City Attorney quite correctly stated that it <br />was not practical or appropriate to impose an ongoing obligation to maintain <br />the property as an express condition of approval; we agree that the enforce- <br />ment of existing regulations, particularly those in the housing code, provide <br />the City with the appropriate mechanism for improving the condition of <br />fraternities and other properties in the University area and elsewhere. <br />On behalf of Beta Psi Housing Corporation, I apologize for the condition <br />of our property as Mr. Towe found it July 6. We have expressed our concern <br />to our tenant, the fraternity chapter, and will be taking definite steps to <br />• require the fraternity to be more responsible for basic upkeep of the property <br />
