0 <br />A RESOLUTION <br />AUTHORIZING EMINENT DOMAIN PROCEEDINGS <br />TO ACQUIRE PARCELS 134 & 135 <br />ON CITY PROPERTY TAS MAP 11 <br />TO BE USED FOR STREETS, WATER, SEWER OR UTILITY PIPES <br />OR LINES OR RELATED FACILITIES <br />WHEREAS, the University of Virginia, in order to accomodate <br />a proposed addition to Jordan Hall (the medical school building) <br />to provide enhanced medical research facilities, needs to close and <br />relocate a portion of Lane Road in the City of Charlottesville; <br />and, <br />WHEREAS, the relocation of Lane Road will necessitate the <br />closing of a portion of the existing Lane Road and acquisition by <br />the City of Charlottesville of two improved properties that are <br />located along the path of the proposed realignment of Lane Road, <br />as depicted on the attached plat; and, <br />WHEREAS, in connection with said project, the City of <br />Charlottesville must approve the closure of the described portion <br />• of Lane Road and obtain fee simple title to property identified as <br />Parcels 134 and 135, City Real Property Tax Map 11, which contains <br />approximately 23,925 square feet, for use as a street, with water, <br />sewer or utility pipes or lines or related facitlites appurtenant <br />to said street and transfer said property to the University of <br />Virginia before the University of Virginia may proceed with the <br />project; and, <br />WHEREAS, bona fide efforts have been made to acquire the <br />property by purchase from the owner, but the efforts have been <br />ineffectual because of the inability to agree on the price or terms <br />of sale of the property; and, <br />WHEREAS, the City has no recourse but to acquire the property <br />through the exercise of its power of eminent domain as authorized <br />by the Code of Virginia and the Charter of the City of <br />Charlottesville; <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br />Charlottesville, Virginia, that the Mayor and Council support and <br />endorse the University project and concur that the relocation of <br />Lane Road and acquisition of the privately owned properties satisfy <br />a public purpose and necessity; and, <br />BE IT FURTHER RESOLVED by the Council of the City of <br />Charlottesville, Virginia that such a public necessity is hereby <br />• declared to exist for the acquisition of fee simple title to <br />Parcels 134 and 135, City Real Property Tax Map 11, as more <br />
