• particularly described on the attached plat, in order to fulfill <br />the public purpose of constructing and providing streets and <br />sidewalks for vehicular and pedestrian traffic; and, <br />BE IT FURTHER RESOLVED by the Council of the City of <br />Charlottesville, Virginia that the City is authorized to acquire <br />title and to enter upon and take possession of such property, to <br />close a portion of Lane Road and proceed with the construction of <br />said relocated street, as provided in Sections 33.1-119 and -120 <br />of the Code of Virginia (1950)(as amended); and, <br />BE IT FURTHER RESOLVED by the Council of the City of <br />Charlottesville, Virginia that the Mayor and Council approve the <br />transfer of the underlying land acquired by this action to the <br />University to accomodate construction of the addition to Jordan <br />Hall; and, <br />BE IT FURTHER RESOLVED by the Council of the City of <br />Charlottesville, Virginia, that the aforementioned actions shall <br />be taken at the request of the University of Virginia, and all <br />expenses (including but not limited to the costs of the property <br />to be acquired, all appraisal costs, legal and expert witness fees, <br />and the like) thereof are to be reimbursed to the City by the <br />University of Virginia, and that George H. Gilliam, a member of the <br />• Virginia State Bar, be designated (at the request of the University <br />of Virginia) as a special city attorney and that he be authorized <br />and directed to institute eminent domain proceedings (including <br />those authorized under Sections 33.1-119 and -120 of the Code of <br />Virginia) to acquire fee simple title to the property identified <br />as Parcels 134 and 135, City Real Property Tax Map 11, and to <br />execute such instruments as may be necessary for the proceedings. <br />Approved by Council <br />July 15, 1991 <br />Clerk of City Council <br />-6-43 <br />• <br />
