• SECTION 6. SALARY <br />A. The Council agrees to pay the Manager for his services <br />rendered during the fiscal year running from July 1, 1993 to <br />June 30, 1994 (the "contract year") an annual base salary of <br />$91,288.00, payable on the same schedule as other salaried <br />employees of the City are paid. <br />B. City Council shall notify the Manager, on or before <br />April 15 of each year in which it intends this agreement to be <br />renewed, of the adjusted annual base salary it will pay the Manager <br />during the ensuing renewal year of the agreement. <br />SECTION 7. PAYMENTS ON NON -RENEWAL AND TERMINATION <br />A. In the event City Council shall elect not to renew this <br />agreement at the end of any contract year, it shall so advise the <br />Manager in writing on or before April 15 of that year, and the <br />Manager shall be entitled to receive his then current compensation <br />and all benefits through June 30 of that year. In addition, <br />beginning on the following July 1 (the start of the next fiscal <br />year) the Council shall also continue Manager's salary and benefits <br />on the same terms as those existing during the preceding contract <br />year for each of the next six (6) months; provided, however, that <br />• such non -renewal payments and benefits shall cease at any time <br />during said six month period that Manager begins receiving <br />compensation as a full time employee from some employer other than <br />the City. <br />B. In the event City Council elects to terminate this <br />agreement at any time during the term of any contract year, whether <br />during the 1993-94 contract year or thereafter, as may be done <br />under the terms of Section 4(A) of the contract, Manager shall be <br />paid all accrued salary and other benefits through the effective <br />date of termination. In addition, City Council shall also continue <br />Manager's salary and benefits on the same terms as those existing <br />immediately prior to termination for each of the nine (9) months <br />subsequent to termination; provided, however, that such post <br />termination payments and benefits shall cease at any time during <br />said nine month period that Manager begins receiving compensation <br />as a full time employee from some employer other than the City. <br />C. For purposes of this agreement, "employee" shall include <br />Manager's work as an independent contractor or consultant. For the <br />purposes of this agreement, "full time" shall mean and refer to any <br />work situation in which Manager (a) receives compensation equal, in <br />weekly or monthly or other installments, to his compensation while <br />last employed by the City or (b) works at least 40 hours per week. <br />D. The non -renewal or termination payments provided for in <br />• this section shall not be considered as part of the Manager's base <br />pay in computing the City's contribution to the Manager's <br />retirement plan pursuant to Section 13 of this contract. <br />Page 3 <br />
