RESOLUTION <br />GRANTING SPECIAL USE PERMIT TO MACAA <br />• TO USE THE FORMER YMCA SITE AT 1025 PARK STREET <br />AS A COMMUNITY EDUCATION CENTER <br />WHEREAS, the Monticello Area Community Action Agency (MACAA), <br />contract purchaser of property located at 1025 Park Street, has <br />requested a special use permit to use the former YMCA site as a <br />Community Education Center; this property being further identified <br />on City Real Property Tax Map #45 as parcel 2, having approximately <br />70 feet of frontage on Park Street, 626 feet of frontage on the 250 <br />Bypass, and containing approximately 343,557 square feet of land, <br />or 7.89 acres; <br />WHEREAS, following a joint public hearing before this Council <br />and the Planning Commission, duly advertised and held on <br />December 8, 1992, this Council finds that such use will conform to <br />the criteria applicable to special permits generally under Chapter <br />34 of the City Code; now, therefore <br />BE IT RESOLVED by the Council of the City of Charlottesville, <br />Virginia that a special use permit is hereby granted to the <br />Monticello Area Community Action Agency to use the former YMCA site <br />as a Community Education Center. <br />The approval of this special use permit is conditioned upon <br />• the following: <br />1. Administrative approval of the site plan: <br />2. A grading and soil erosion/sediment control plan shall be <br />submitted with an application, $50.00 fee, four copies of the <br />narrative and four plan copies prior to final site plan approval. <br />This plan shall be approved and bonded, and shall include data on <br />the linear feet of silt fence, curbing and pipes as well as on the <br />number and sizes of drainage structures to assist in setting the <br />bond amount. <br />3. The hours of operation by MACAA or any auxiliary uses <br />shall not exceed 9:00 p.m. on Sunday through Thursday, 11:00 p.m. <br />on Friday and 10:00 p.m. on Saturday. <br />4. All site plan improvements must be implemented within one <br />year of the approval of the special permit, or all uses will cease <br />to operate until the improvements are completed; provided, however, <br />that twenty (20) of the ninety-five (95) required parking spaces <br />may be installed within two (2) years of the approval of the <br />special permit. <br />5. There shall be physical barriers on access roads during <br />prohibited hours of operation. <br />• Approved by Council <br />January 4, 1993 <br />e k of City Council <br />
