RESOLUTION <br />AMENDING THE SPECIAL USE PERMIT GRANTED <br />• TO MONTICELLO AREA COMMUNITY ACTION AGENCY <br />TO ALLOW CHANGES IN TRAFFIC ACCESS TO <br />THE COMMUNITY EDUCATION CENTER ON PARK STREET. <br />WHEREAS, the Monticello Area Community Action Agency (MACAA), <br />owner of the property at 1025 Park Street, has requested an <br />amendment to the special use permit granted by City Council on <br />January 4, 1993 (copy attached), in order to eliminate access from <br />said property onto the Route 250 Bypass and make traffic control <br />improvements at the Park Street entrance; this property being <br />further identified as Parcel 2 on City Real Property Tax Map 45, <br />having approximately 70 feet of frontage on Park Street, 626 feet <br />of frontage on the 250 Bypass, and containing approximately 343,557 <br />square feet of land or 7.89 acres; <br />WHEREAS, following a joint public hearing before this Council <br />and the Planning Commission, duly advertised and held on June 8, <br />1993, this Council finds that such use will conform to the criteria <br />applicable to special permits generally under Chapter 34 of the <br />City Code; now, therefore <br />BE IT RESOLVED by the Council of the City of Charlottesville, <br />Virginia that the special use permit granted on January 4, 1993, <br />for the Community Education Center of MACAA is, for a one year <br />• trial period, amended to eliminate the following requirements: (a) <br />that there be access from said property onto the Route 250 Bypass, <br />and (b) that the entrance at Park Street be chained off. Said trial <br />period shall begin running on the date this amended special use <br />permit is approved by Council and end one year thereafter. <br />The approval of this amendment to the special use permit is <br />conditioned upon the following: <br />1. Phase I of the site plan shall be completed within one <br />year of the approval of this amendment to the special use <br />permit; and <br />2. Phase I of the site plan shall include installation and <br />reactivation of the flashing warning sign on Park Street <br />at MACAA's expense, and modifications to the Park Street <br />entrance for two-way uniform width and improved turning <br />radius; and <br />At or near the end of trial period, if MACAA wishes to <br />eliminate the 250 access and Park Street chaining requirements on• <br />a permanent basis, MACAA shall seek another amendment to this <br />special use permit. Absent such an amendment by Council, these two <br />requirements shall be deemed reimposed and become a integral part <br />• of this permit. <br />Approved by Council <br />July 6, 1993 k of City Council <br />
