• <br />• <br />• <br />RESOLUTION <br />APPROVING A SPECIAL USE PERMIT <br />TO ATO FRATERNITY HOUSE CORPORATION <br />FOR USE OF 125 CHANCELLOR STREET <br />AS A FRATERNITY HOUSE. <br />WHEREAS, ATO Fraternity House Corporation has requested a <br />special use permit to use the house at 125 Chancellor Street as a <br />fraternity house; this property being further identified as Parcel <br />137 on City Real Property Tax Map 8, having 74 feet of frontage on <br />Chancellor Street and containing approximately 10,800 square feet <br />of land or .25 acres; <br />WHEREAS, following a joint public hearing before this Council <br />and the Planning Commission, duly advertised and held on <br />September 12, 1995, this Council finds that such use will conform <br />to the criteria applicable to special permits generally under <br />Chapter 34 of the City Code; now, therefore <br />BE IT RESOLVED by the Council of the City of Charlottesville, <br />Virginia that a special use permit is hereby granted to ATO <br />Fraternity House Corporation to use the house at 125 Chancellor <br />Street as a fraternity house. <br />The approval of this special use permit is conditioned upon <br />the following: <br />1. Administrative approval of a site plan which includes plans <br />for adequate on-site parking for no less than 7 automobiles. <br />2. Access to the building for persons with a disability in accord <br />with ADA standards. <br />3. The alley to the rear of the subject property shall be paved <br />and maintained by Applicant with signage provided by Applicant <br />prohibiting parking in the alley - all of which is intended to <br />allow adequate access to the on-site parking. <br />4. The subject property must be kept and maintained by Applicant <br />in strict compliance with (a) City Code 917-30 which prohibits <br />accumulations of refuse, trash, broken glass, paper, etc.; (b) <br />the Virginia Statewide Fire Prevention Code; and (c) the <br />Virginia Uniform Statewide Building Code, including but not <br />limited to Property Maintenance (PM) Sections 304.5 (related <br />to weatherproofing and surface coating of walls), 304.6 <br />(related to roofs and drainage), and 304.11 and 304.11.1 <br />(related to window and door frames and glazing). Such <br />maintenance compliance shall include annual inspections by <br />City Code officials pursuant to the "Contract" between the <br />Applicant and the University of Virginia. <br />5. Any exterior changes to the building and site which are or <br />will be subject to public view from any public street or <br />public right-of-way must be reviewed by the Board of <br />Architectural Review before these changes are effected. <br />Approved by Council <br />October 16, 1995 <br />C erk of City Counci <br />
