0 RESOLUTION REGARDING ADOPTION OF AN "ACCOUNTING ORDER" PURSUANT TO APPLICABLE FEDERAL COMMUNICATIONS COMMISSION REGULATIONS TO PRESERVE THE CITY'S AUTHORITY WITH RESPECT TO ADELPHIA'S PROPOSED CABLE TELEVISION RATES. WHEREAS, the City of Charlottesville, Virginia ("City") is the Grantor of a Cable Communications Franchise Ordinance ("Ordinance") executed on or about June 15, 1992 by and between the City and Multi -Channel T.V. Cable Company d/b/a Adelphia Cable Communications (hereinafter "Grantee" or "Adelphia"); and WHEREAS, in accordance with applicable provisions of the Cable Consumer Protection and Competition Act of 1992 (hereinafter the "Cable Act") and rules adopted by the Federal Communications Commission ("FCC"), the City has undertaken all appropriate procedural steps to regulate the basic cable service tier and associated equipment pursuant to 47 C.F.R. Part 76, Subpart N §§ 76.900 - 76.987; and WHEREAS, on April 21, 1995, Adelphia submitted to the City FCC Form 1220 seeking to justify basic service tier rates utilizing a cost of service analysis; and • WHEREAS, pursuant to 47 C.F.R. § 76.933, the City provided Grantee with written notice that the time period for review of Grantee's FCC Form 1220 would be extended for an additional 150 days; and WHEREAS, the City is continuing to review the rates proposed by Grantee within Grantee's FCC Form 1220; and WHEREAS, on this date the City has conducted a meeting open to the public to ensure that all interested parties have had ample opportunity to present information to the City regarding this issue; and WHEREAS, based upon all information available to the City the City has determined to make the below listed Orders for Action. NOW, THEREFORE, in a regular meeting of the City Council of the City of Charlottesville, Virginia, on October 2, 1995, the following is resolved: ORDERS FOR ACTION 1. The City hereby adopts and makes a part of this Resolution all documents • referenced above.
