0 <br />RESOLUTION <br />REGARDING ADOPTION OF AN "ACCOUNTING ORDER" <br />PURSUANT TO APPLICABLE FEDERAL COMMUNICATIONS COMMISSION <br />REGULATIONS TO PRESERVE THE CITY'S AUTHORITY WITH RESPECT <br />TO ADELPHIA'S PROPOSED CABLE TELEVISION RATES. <br />WHEREAS, the City of Charlottesville, Virginia ("City") is the Grantor of a Cable <br />Communications Franchise Ordinance ("Ordinance") executed on or about June 15, 1992 by and <br />between the City and Multi -Channel T.V. Cable Company d/b/a Adelphia Cable <br />Communications (hereinafter "Grantee" or "Adelphia"); and <br />WHEREAS, in accordance with applicable provisions of the Cable Consumer Protection <br />and Competition Act of 1992 (hereinafter the "Cable Act") and rules adopted by the Federal <br />Communications Commission ("FCC"), the City has undertaken all appropriate procedural steps <br />to regulate the basic cable service tier and associated equipment pursuant to 47 C.F.R. Part 76, <br />Subpart N §§ 76.900 - 76.987; and <br />WHEREAS, on April 21, 1995, Adelphia submitted to the City FCC Form 1220 seeking <br />to justify basic service tier rates utilizing a cost of service analysis; and <br />• WHEREAS, pursuant to 47 C.F.R. § 76.933, the City provided Grantee with written <br />notice that the time period for review of Grantee's FCC Form 1220 would be extended for an <br />additional 150 days; and <br />WHEREAS, the City is continuing to review the rates proposed by Grantee within <br />Grantee's FCC Form 1220; and <br />WHEREAS, on this date the City has conducted a meeting open to the public to ensure <br />that all interested parties have had ample opportunity to present information to the City regarding <br />this issue; and <br />WHEREAS, based upon all information available to the City the City has determined <br />to make the below listed Orders for Action. <br />NOW, THEREFORE, in a regular meeting of the City Council of the City of <br />Charlottesville, Virginia, on October 2, 1995, the following is resolved: <br />ORDERS FOR ACTION <br />1. The City hereby adopts and makes a part of this Resolution all documents <br />• referenced above. <br />
