C. "Plaintiffs" means Dan Burke, James Finnerty, Mark Stoler, Munsey Wheby,
<br />• Martin Bass, Heather Clark, Laurice Batton, Rebecca Batton, St. John the Baptist Episcopal
<br />Church, William J. Clark, Dorothy Clark, William Rockwell, Peacock Hill Service Company — a
<br />Virginia corporation, William Hiter, Patsy Hiter, Barbara Snead, William Clark, Jr., Terry
<br />Turner, and each of their heirs, successors, including but not limited to successors in interest and
<br />successors in title to any of the real property specifically affected by this Agreement (specifically
<br />Laurice and Rebecca Batton, William and Patsy Hiter, and Barbara Snead), and assigns.
<br />D. "Action" means the action captioned, Gertrude Weber, et al. v. Rivanna Solid
<br />Waste Authority, et al., filed in the United States District Court for the Western District of
<br />Virginia, Charlottesville Division and assigned Civil Action No. 98-0109-C, including all
<br />amendments to the Action.
<br />E. "Ivy landfill" means: All that certain tract or parcel of land situated in the Samuel
<br />• Miller Magisterial District, Albemarle County, Virginia, fronting on the northwestern side of
<br />•
<br />State Route 637, consisting of 302.15 acres, more or less, being the land shown on a plat entitled
<br />"Continental Can Company, Inc. 'Douglas Tract' Composite Tract," on file in the office of the
<br />County Engineer, Albemarle County, Virginia; LESS AND EXCEPT 0.21 acres conveyed to
<br />the Diocesan Missionary Society of Virginia by deed dated December 16, 1961 of record in the
<br />Clerk's Office of the Circuit Court of Albemarle County in Deed Book 374, page 340; 10.54
<br />acres conveyed to the Commonwealth of Virginia by certificate dated May 5, 1967 of record in
<br />the aforesaid Clerk's Office in Deed Book 428, page 544, as confirmed by order dated January
<br />28, 1970 of record in Deed Book 468, page 589; and 1.0 acre conveyed to the Diocesan
<br />Missionary Society of Virginia by deed dated February 1, 1974 of record in Deed Book 548,
<br />page 203; BEING all the same property conveyed to the Rivanna Solid Waste Authority by deed
