The <br />• laboratories where the samples are sent for analysis shall be chosen from a list developed by the <br />Parties' respective consultants. The laboratory will analyze the samples for the list of <br />constituents in Exhibit 3 and provide a contract laboratory program (CLP) -like, Level IV data <br />quality assurance/quality control (or such other more accurate data quality assurance/quality <br />control package that may be developed in the future, hereinafter referred to as "Level IV <br />QA/QC") package for data qualification in accordance with recognized and approved EPA data <br />validation protocols. The RSWA and the Plaintiffs shall perform a QA of the laboratory QC data <br />in accordance with U.S.E.P.A. guidance documents, "Region III Modifications to the Laboratory <br />Data Validation — Functional Guidelines for Evaluating Inorganic Analyses (April 1993), and <br />Region III Modifications to National Functional Guidelines for Organic Data Review Multi - <br />Media, Multi -Concentration" (September 1994). For any samples of the "sentinel' well(s) taken <br />• and analyzed by either the RSWA or any Plaintiff for whom a well serves as a "sentinel' well for <br />their drinking water supply, the results of the "sentinel' well sampling shall be provided to the <br />RSWA and to the Plaintiff for whom the sampled well serves as a "sentinel' for their drinking <br />water supply, by the laboratory (laboratories in the case of a split sample) at the same time. It is <br />understood by the Parties that until the qualified consultants of the Parties complete the Level IV <br />QA/QC data qualification in accordance with recognized and approved EPA data validation <br />protocols, the sampling results provided by the laboratory for any sampling event will not be <br />considered valid.
