Plaintiffs shall be completed and the results will be reported within eight (8) months after the <br />• entry of the Order dismissing the Action. The Parties understand that the report of sample results <br />may be delayed beyond this time period due to potential verification re -sampling or QA/QC data <br />validation procedures. Any verification re -sampling that is conducted as a result of finding that a <br />sampling result for a contaminant is deemed "qualified" or "estimated" under approved EPA data <br />validation protocols or is otherwise deemed to be a questionable or an unreliable result, shall be <br />performed as promptly as is reasonably possible, however, such verification re -sampling shall <br />not exceed forty-five (45) days after completion of the data validation procedures call the results <br />into question. Further, the QA/QC samples for the baseline and future sampling of all "sentinel' <br />wells, and drinking water supply wells of the Plaintiffs, will be collected and maintained <br />independently from the QA/QC samples independently collected and maintained for <br />groundwater monitoring wells located on the Ivy landfill property. <br />• 2. The Batton Property Acquisition Contingency. <br />• <br />Under the occurrence of the conditions set forth below, the RSWA will purchase all of <br />the real property adjacent to the Ivy landfill that is owned by the Batton Plaintiffs. The price for <br />this Batton property and the conditions for payment shall be determined as follows. <br />Upon the occurrence of the conditions described in this subparagraph, the RSWA will <br />purchase and the Batton Plaintiffs will convey to the RSWA good and marketable fee simple title <br />in the real estate and improvements adjacent to the Ivy landfill, free and clear of all <br />encumbrances, tenancies, liens and leases and subject only to applicable easements and <br />restrictions of record which do not adversely affect the marketability of title at closing. In <br />exchange for said fee simple title, the RSWA shall pay to the Batton Plaintiffs the actual amount <br />paid for the real estate currently owned by the Batton Plaintiffs together with the cost of <br />17 <br />
