DEQ are complete. The obligations and benefits of the Batton Plaintiffs and the RSWA with <br />• respect to this Agreement shall be binding upon their heirs, successors in interest, and assigns <br />and shall inure to their benefit and shall run with the land until such time as the obligations <br />hereunder have expired by the terms of this Agreement. <br />3. Groundwater Issues Concerning the Western Landfill Boundary Plaintiffs. <br />If groundwater contamination (represented by a verified detection, as defined above, for <br />any of the constituents listed on Exhibit 3, attached hereto), is detected in any of the "sentinel' <br />well(s) identified as part of this Agreement at concentrations above maximum contaminant levels <br />("MCLs") where established by EPA or alternative concentration levels ("ACLs") established in <br />the facility's permit, the RSWA will immediately install appropriate groundwater treatment <br />devices on the drinking water system/well(s) of the Plaintiff(s) for whom the "sentinel' well(s) <br />that had the reported contaminant detection is a sentinel. The consultants will determine where <br />• to locate any additional "sentinel' well(s) (which may be located on or west of the strips of land <br />to be purchased by the RSWA pursuant to Section C. 4 of this Agreement), near the western <br />• <br />boundary of the Ivy landfill and beyond the DEQ approved groundwater monitoring compliance <br />network, to ensure that any such well will intercept any of the constituents listed on Exhibit 3 <br />before any of said constituents reach the drinking water wells of the Plaintiffs residing to the <br />west of the Ivy landfill. In addition, the RSWA will test and analyze samples obtained at the <br />drinking water system/well(s) upon which the treatment devices have been installed (prior to <br />treatment of the groundwater), for any of the contaminant(s) listed on Exhibit 3 once each <br />calendar month for a period of one year. If during said year, a verified detection of any of the <br />contaminant(s) listed on Exhibit 3 is detected in samples from the pre-treatment drinking water <br />system/well(s) upon which the treatment devices have been installed at a concentration greater <br />20 <br />
