than 75% of the MCLS or ACLS established for the contaminant(s), the RSWA shall supply safe
• potable water to the Plaintiff(s) whose drinking water system/well(s) have been so affected. In
addition, the RSWA will initiate the identical procedure of testing, potential installation of
treatment devices depending on test results, and provision of safe potable water for the Plaintiffs
who are immediately adjacent to the affected drinking water well(s). If any one of the verified
reported contaminant(s) listed on Exhibit 3 were detected in the "sentinel' well(s), but none of
the Exhibit 3 contaminants are detected in the drinking water system/wells in the groundwater
flow path upon which treatment devices have been installed during the once a month for one-
year monitoring period described in this subparagraph, the RSWA will reduce the groundwater
monitoring frequency of the drinking water system/well(s) to a frequency consistent with that
required of the groundwater monitoring program for the Ivy landfill mandated by the applicable
VSWMR. If the groundwater monitoring results for that affected "sentinel' well(s) return to
• contaminant detection concentrations below established MCLS or ACLS for three consecutive
•
years, the RSWA monitoring program of that "sentinel' well(s) will revert to the scope and
frequency mandated by the VSWMR for the Ivy landfill. Furthermore, the groundwater
monitoring program and maintenance of the treatment system(s) on the drinking water
system/well(s) may be discontinued along with any duty by RSWA to provide potable drinking
water for the affected Plaintiff(s) unless verified concentrations of the contaminant(s) continue to
be detected in the drinking water system/well(s) during the three-year period. The groundwater
monitoring program and maintenance of the treatment system(s) on the drinking water
system/well(s) may be discontinued along with any duty by RSWA to provide potable drinking
water for the affected Plaintiff(s) if there are no Exhibit 3 contaminant verified detection's in the
drinking water system/well(s) during a consecutive three-year monitoring period when the
21
