Regardless of any other provision of this <br />0 <br />Agreement the provisions of this subparagraph shall apply to all Plaintiffs, including Plaintiff St. <br />John the Baptist Episcopal Church, except the Batton Plaintiffs (to which paragraph B. 1, above <br />applies) and the Peacock Hill Service Company. The provisions of the immediately following <br />subparagraph "4" shall apply only to the Peacock Hill Service Company ("Peacock Hill"). The <br />RSWA agrees to provide written notification to each Plaintiff with property adjoining the Ivy <br />landfill along its western boundary line with a drinking water well at least thirty (30) days before <br />sampling of the "sentinel" well(s) described above in this paragraph and, if a written request is <br />made prior to the sampling'date, the RSWA agrees to permit a qualified consultant employed by <br />any adjoining property owner or owners (following the same sampling and laboratory analytical <br />protocols followed by the RSWA consultant) to split samples from any of the wells at the <br />property owners' expense. All groundwater monitoring samples from the sentinel well(s) and the <br />groundwater monitoring compliance network identified in this § B, of this Agreement shall be <br />delivered directly to any qualified laboratory agreed upon by the consultants for analysis. For <br />the split samples described herein, the results shall be provided by the laboratory to the Plaintiffs <br />requesting split samples and to the RSWA at the same time. It is understood by the Parties that <br />until the qualified consultants of the Parties complete the Level IV QA/QC data validation in <br />accordance with recognized and approved EPA data validation protocols, the sampling results <br />provided by the laboratory for any sampling event will not be considered valid. <br />4. Groundwater Issues Concerning Peacock Hill. <br />If groundwater contamination (represented by verified detection of any of the <br />contaminants listed on Exhibit 4 for Peacock Hill) is detected in monitoring well 35 DD ("MW - <br />22 <br />
