35131)"), (whose location in the I-64 median strip between the Ivy landfill and Peacock Hill is <br />• shown on groundwater monitoring plan maps prepared by Joyce Engineering, Inc.), at <br />concentrations above the MCLS or ACLS established in the Ivy landfill permit, the RSWA will <br />immediately install at least one additional "sentinel' well north of MW-35DD located between <br />MW-35DD and the Peacock Hill drinking water system/well(s) at location(s) agreed upon by <br />consultants for the Plaintiffs and the RSWA, assuming that access to the agreed location(s) may <br />be obtained from the property owner whose location(s) are selected. If groundwater <br />contamination represented by verified detection of any of the contaminants listed on Exhibit 4 <br />for Peacock Hill is detected in the newly installed "sentinel' well(s) at concentrations above the <br />established MCLS or ACLs, the RSWA will immediately install (subject to obtaining access <br />agreements from the property owner(s)) appropriate groundwater treatment devices on all of the <br />Peacock Hill drinking water system well(s) unless the consultants for the Plaintiffs and the <br />• RSWA concur that one or more of the Peacock Hill drinking water system wells are not likely to <br />be impacted due to their physical characteristics or geographic location as it relates to the <br />groundwater flow. The RSWA will have the right to "rebut' the presumption that any <br />contaminant listed on Exhibit 4 migrated from the Ivy landfill if it can reliably demonstrate that <br />there is an alternate source for the contaminant based upon an occurrence that can be <br />demonstrated to the Plaintiffs' consultant. If no agreement is obtained among the consultants for <br />• <br />the Plaintiffs and the RSWA, the dispute resolution procedure established below to finally <br />resolve any disputes between the consultants for the Plaintiffs and the RSWA will be engaged, <br />provided however, where the effect of the dispute would involve a delay in providing safe <br />drinking water to the Peacock Hill drinking water system/wells that is unacceptable to the <br />Peacock Hill Plaintiffs, the RSWA will provide a temporary source of safe drinking water <br />23 <br />
