pending the outcome of the dispute. If the RSWA succeeds in demonstrating that the detected <br />• contamination did not come from the Ivy landfill, then the Peacock Hill Service Company shall <br />assign to the RSWA and subrogate any rights to which the Peacock Hill Service Company may <br />be entitled for any recovery for the expenses of the temporary water supply obtained by <br />settlement or judgment from the party responsible for the contamination of the Peacock Hill <br />Service Company water supply. In addition, the RSWA will analyze groundwater samples (prior <br />to treatment) obtained from the Peacock Hill drinking water system/well(s) upon which the <br />treatment device(s) have been installed, for the contaminants listed on Exhibit 4 once each <br />calendar month for a period of one year. If during said year, a verified detection of any of the <br />contaminant(s) listed on Exhibit 4 is detected in the Peacock Hill drinking water system/well(s) <br />upon which the filtration devices have been installed, sampled prior to entering the treatment <br />system, at a concentration greater than 75% of the MCLS or ACLS established for the <br />• contaminant, temporary safe potable water will be supplied as soon as reasonably possible to the <br />Peacock Hill resident(s) who utilize the affected Peacock Hill drinking water system/well(s) at <br />the same cost to the residents that they paid to the Peacock Hill Service Company until a more <br />• <br />permanent solution can be provided. The precise means by which a permanent safe potable <br />water will be supplied to the affected Peacock Hill resident(s) shall be developed after <br />consultation among the appropriate water supply engineering, hydrogeologic and/or other <br />technical experts retained by Peacock Hill and the Defendants with the ultimate solution subject <br />to approval by the Board of Supervisors of Albemarle County. <br />5. Dispute Resolution Mechanism with Respect to Groundwater Issues. <br />For any decisions under this Agreement with respect to which the hydrogeology <br />consultant(s) for the RSWA and the hydrogeology consultant(s) for the Plaintiffs are unable to <br />24 <br />
