RESOLUTION <br />is <br />EXTENSION OF 2001 OUTDOOR CAFE PERMITS <br />WHEREAS, City Staff is currently studying the annual process by which applications <br />for the use of public sidewalks and the downtown mall as outdoor cafe areas are reviewed and <br />granted; and <br />WHEREAS, staff recommendations for revisions to this process, as well as the <br />ordinances set forth in Chapter 28 of the City Code, are expected to be completed in time to be <br />considered by City Council in March 2002; and <br />WHEREAS, the outdoor cafd permits granted for the 2001 cafe season were set to expire <br />on November 30, 2001, but were extended by previous resolution of this Council through <br />December 31, 2001; and <br />WHEREAS, at this time Council desires to extend all existing permits to allow permit <br />holders who desire to do so to continue operating through the winter months, subject to the <br />agreement of such permit holders to be responsible for the costs of removing any ice and snow <br />which may accumulate within their outdoor cafd areas during the extended period of time; <br />NOW, THEREFORE, BE IT RESOLVED that all existing outdoor cafe permits issued <br />by the City pursuant to Chapter 28, Article VI, Division 2 of the City Code, valid for the period <br />of March 1, 2001 through December 31, 2001 are hereby extended, and shall remain in effect, <br />through March, 2002. No new permits shall be issued by the City for the period of January 1, <br />2002 through March 31, 2002. <br />BE IT FURTHER RESOLVED that during the period of this extension, it shall be a <br />condition of the extended permit that each permit holder who chooses to continue operations <br />shall be responsible for keeping his cafd area free and clear of ice and snow, and that the operator <br />shall post a bond in the amount of five hundred dollars ($500.00) to guarantee this obligation. If <br />the operator fails to meet this obligation and the City must act to clear the area, then the permit <br />holder shall be required to reimburse the City for any costs incurred for such removal (such costs <br />to be deducted by the City from the bond; amounts in excess of the bond will be billed to and <br />payable by the operator), and the City may revoke the cafe operator's permit. <br />Approved by Council <br />December 17, 2001 <br />erk of City Council <br />
