RESOLUTION <br />GRANTING AN AMENDMENT TO A SPECIAL USE PERMIT (SP -02-10-15) <br />• FOR EXPANSION OF THE AMUSEMENT ARCADE <br />ON PROPERTY LOCATED AT 230 WEST MAIN STREET <br />(CHARLOTTESVILLE ICE PARD <br />WHEREAS, the owner of the Charlottesville Ice Park located at 230 West Main Street has <br />requested an amendment to the special use permit granted by City Council on June 16, 1997, seeking to <br />allow an amusement arcade within the Ice Park to be enlarged from 1,000 square feet to 1,500 square feet <br />and relocated to the Water Street Terrace portion of the building; and <br />WHEREAS, the properties which are the subject of this application may be further identified as <br />Parcel 1 and a portion of Parcel 9.1 on 2002 City Real Property Tax Map 28, having, collectively, <br />approximately 336 feet of frontage on the Downtown Mall, 154 feet of frontage on Water Street, and <br />containing approximately 40,794 square feet of land or .94 acres; and <br />WHEREAS, a joint public hearing on this application was held before the City Council and <br />Planning Commission on November 19, 2002, following notice to the public and to adjacent property <br />owners as required by law; and <br />WHEREAS, this Council finds that such use will conform to the criteria applicable to special <br />permits generally under Chapter 34 of the City Code; now, therefore <br />• BE IT RESOLVED by the Council of the City of Charlottesville, Virginia that the special use <br />permit granted by City Council on June 16, 1997, is hereby amended to allow enlargement of the <br />amusement arcade within the Ice Park from 1,000 square feet to 1,500 square feet and relocation of the <br />arcade to the Water Street Terrace portion of the Charlottesville Ice Park. This amended special use <br />permit is conditioned upon the following: <br />1. The amusement arcade shall be located in the area shown on the approved plan, consisting of <br />approximately 1,500 square feet of floor area at the terrace level of 230 West Main Street and <br />accessed through the Ice Park lobby only. <br />2. The hours of operation shall be limited to the hours of operation for the Ice Park; however the <br />amusement arcade shall not operate any later than midnight. <br />3. At all times during operation of the amusement arcade, a manager and a minimum of one <br />employee shall be on duty at the Ice Park to monitor use of the arcade. <br />4. The amusement arcade shall not be used for gaming or other activities requiring special state <br />license (such as lotto or off-track betting). <br />5. The number of people permitted by the Building code to occupy the amusement arcade space shall <br />be posted in the facility. <br />6. The Water Street exit door from the Ice Park shall be for emergency use only. <br />7.
