SP -02-10-14 <br />RESOLUTION <br />• APPROVING A SPECIAL PERMIT FOR HIGHER DENSITY <br />RESIDENTIAL DEVELOPMENT <br />ON PROPERTY IDENTIFIED AS 222 SOUTH STREET <br />WHEREAS, pursuant to the Code of the City of Charlottesville, section 34-464(1), <br />William G. Chapman, on behalf of 220 South Street, LLC, has requested a special use permit to <br />allow additional residential density for property located at 222 South Street, identified on the <br />2002 City Tax Map 28 as Parcel 95; <br />WHEREAS, a joint public hearing on this application was held before the City Council <br />and Planning Commission on November 19, 2002, following notice to the public and to adjacent <br />property owners as required by law; and <br />WHEREAS, this application seeks permission for the owner to convert a building <br />fronting along South Street ("Original Building") from commercial to residential use, by <br />establishing therein up to five (5) residential dwelling units (there currently exist five dwelling <br />units within an apartment building constructed in 1994 on the back portion of the property <br />("Rear Building")), for a total site density of up to 38.0228 units per acre; and <br />WHEREAS, the subject parcel is zoned B-4 (Business District) wherein residential <br />density of up to twenty-one units per acre is allowed by -right, and the area of this parcel is <br />11,467 square feet (0.263 acre), which allows up to five dwelling units as a matter of right; and <br />• WHEREAS, the City's Comprehensive Plan designation for the parcel is "mixed-use"; <br />and <br />WHEREAS, this City Council finds and determines that the proposed use/density is <br />authorized pursuant to City Code sections 34-463(1) and 34-464(1), and that it will conform to <br />the criteria generally applicable to special use permits under Chapter 34 of the City Code; now, <br />therefore, <br />BE IT RESOLVED by the Charlottesville City Council that a special use permit is <br />hereby granted for additional residential density for the property located at 222 South Street <br />(2002 City Tax Map 28, Parcel 95), subject to the following conditions designed to protect <br />against adverse impacts on the surrounding neighborhood and community: <br />1. This Special Permit is granted to allow the establishment of up to four one -bedroom <br />dwelling units within the Original Building, thereby allowing a. site total (for Tax Map 28 <br />Parcel 95, in its entirety) of not more than 9 dwelling units containing, collectively, not <br />more than 14 bedrooms: an overall density of up to 34.22 dwelling units per acre. <br />2. To avoid the adverse impact on adjacent properties that would result if each resident of a <br />dwelling unit were to place a trash container on the public right-of-way for individual <br />pick-up, there shall be provided a centralized system for outdoor trash storage and pick- <br />up for use by all the dwelling units located on this parcel. <br />• Approved by Council <br />December 2, 2002 C1 rc of City Council <br />
