RESOLUTION <br />GRANTING A SPECIAL USE PERMIT (SP -02-10-13) <br />• FOR A CHILD DAY CARE FACILITY <br />ON PROPERTY LOCATED AT 1405 EAST MARKET STREET <br />(LIVING STONES CHAPEL) <br />WHEREAS, the Living Stones Chapel has requested a special use permit to allow operation of a <br />child day care center at 1405 East Market Street (R-lA zoning district) for up to fourteen (14) children; <br />this property being further identified as Parcels 42, 42.1, 42.2 and 42.3 on 2002 City Real Property Tax <br />Map 55, having, collectively, approximately 200 feet of frontage on East Market Street, 200 feet of <br />frontage on Fairway Avenue, and containing approximately 40,000 square feet of land or .92 acres; <br />WHEREAS, a joint public hearing on this application was held before the City Council and <br />Planning Commission on November 19, 2002, following notice to the public and to adjacent property <br />owners as required by law; and <br />WHEREAS, this Council finds that such use is authorized pursuant to City Code Section 34- <br />147(1) and that it will conform to the criteria applicable to special permits generally under Chapter 34 of <br />the City Code; now, therefore <br />BE IT RESOLVED by the Council of the City of Charlottesville, Virginia that a special use <br />permit is hereby approved and granted to allow operation of a child day care center for up to fourteen (14) <br />children. This special use permit is conditioned upon the following: <br />is 1. Administrative approval of a final site plan. <br />2. Maximum enrollment of fourteen (14) children. <br />3. Three off-street parking spaces (including at least one handicapped space) must be provided and <br />paved in accordance with City standards. <br />4. Adequate entry drive must be constructed to provide access to the day care center. <br />5. The drop-off area and the play area, with proper fencing, must be shown on the final site plan. <br />Approved by Council <br />December 2, 2002 <br />e k of City Council <br />0 <br />
