• RESOLUTION WHEREAS, the 55h annual Dogwood Festival will take place from April 13-25, 2004; and WHEREAS, it has been requested that Council waive certain license tax and other requirements applicable to the Dogwood Festival, for the duration of the Festival; and WHEREAS, City Council is willing to support this request to the extent set forth below; now, therefore, BE IT RESOLVED that the following fees and requirements are waived for the Dogwood Festival: 1. The carnival business license tax imposed by City Code §14-23(1) ($550/day); 2. The tent erection fee imposed by City Code §5-56 ($50); 3. The zoning inspection. 4. Fees for inspection of amusement rides associated with festival. BE IT FURTHER RESOLVED by the Council that the following matters, to the extent applicable, are not waived: 1. Peddler's license and fee imposed by City Code §14-17(d). • 2. Policing deposit for carnival imposed by City Code §3-2 ($50/day). 3. Vendor regulations in accordance with City Code §28-111, et seq., provided, however, that vendors shall be allowed to operate until 11:00 p.m. for the duration of the festival. 4. Liability insurance in the amount of at least $1,000,000 with certificate of insurance naming City as an additional insured. 5. Permit for fireworks display approved by Fire Department. 6. Inspection of amusement rides. BE IT FURTHER RESOLVED that the Dogwood Festival Board shall be responsible for: (a) Providing five (5) portajohns at McIntire Park during the festival, one of which shall be handicapped accessible. (b) Payment for additional dumpsters (and collection of refuse from the dumpsters) at the carnival site. (c) Cost of electricity, which shall be billed to the Dogwood Festival Board. (d) Repair costs, if any, to the grounds at McIntire Park. The Dogwood Festival Board will comply with the mutually agreed upon process (copy attached) intended to limit damage to the park grounds. i Approved by Council • February 2, 2004 Cie of City Council
