4. QUIET ENJOYMENT. Lessor covenants that, upon payment of rent and conditioned
<br />upon performance of all of the covenants and conditions of this Lease, the Lessees shall
<br />peacefully and quietly have, hold and enjoy the said leased Premises for the term aforesaid.
<br />5. DEFAULT. If said Premises shall be abandoned, deserted or vacated by the Lessees, or if
<br />the Lessees cease to occupy the Premises, then it shall be lawful for the said Lessor, his
<br />agents, attorneys, successors or assigns to re-enter and take possession of the Premises.
<br />Lessor shall have the further right to re-enter and take possession of the Premises if the
<br />Lessees have not, on or prior to October 31, 2004 tendered to Lessor a Contract of
<br />Purchase and Sale for the Premises, at a sales price of Seven Hundred and Seventy
<br />Thousand and 00/100 Dollars ($770,000.00), with standard terms and conditions for the
<br />sale of commercial property. Upon any such re-entry the Lessees' rights under this Lease
<br />shall terminate.
<br />6. CONDITION OF PREMISES. The Lessees accept said premises and fixtures therein, if
<br />any, in their present condition and agree to keep said premises and fixtures in a good clean
<br />condition; to commit no waste thereon; to obey all laws and ordinances affecting said
<br />premises; and in the event of default under paragraph 5 herein to surrender the premises
<br />and fixtures in like condition as when taken, reasonable wear and tear excepted; provided,
<br />however, that Lessees shall have the right to make any modifications and improvements to
<br />the entire Premises, both building and grounds included, and to place fixtures therein, as it
<br />deems necessary or convenient to its use of the Premises for occupancy by staff of the
<br />• Juvenile and Domestic Relations District Court. All modifications and improvements by
<br />Lessees to the premises shall be in compliance with all building codes, ordinances, rules
<br />and regulations made applicable by law. Lessees shall be responsible for all repairs to the
<br />leased Premises necessitated by its use or occupancy thereof. If Lessee fails to repair any
<br />such damage, Lessor will repair such damage and the cost thereof shall be deemed
<br />additional Rent under this Lease.

<br />7. UTILITIES. Lessees shall pay all electric, water, and sewer bills for the Premises.
<br />Lessees shall also pay for any other utilities or expenses for services used by Lessee at the
<br />Premises, including, but not limited to: telephone, cable television, security, inter-
<br />department communication, internet services, and similar services.
<br />8. MAINTENANCE BY LESSOR During the term of this Lease Lessor shall, at it
<br />expense, maintain the structural elements of the building of which the Premises are a part
<br />in good condition and shall repair or replace the same with reasonable diligence when
<br />necessary. The structural elements shall include the roof, exterior walls, structural
<br />supports, windows and major systems such as plumbing, electrical, heating, ventilating and
<br />air conditioning. Lessor shall be under no obligation to repair or replace said structural
<br />elements to the extent that they are modified, replaced or altered by Lessees, or damaged
<br />by any act or omission by Lessees. In the event that Lessor is obligated to repair or replace
<br />any structural element, as defined herein, the parties may agree that Lessees shall make
<br />such repairs or replacements, with the cost thereof deducted from the rent that would
<br />otherwise be due under the terms of this Lease.
