RESOLUTION GRANTING AN AMENDMENT <br />O TO A SPECIAL USE PERMIT (SP45-01-02) FOR INCREASED DENSITY <br />AT 201, 203, 205, 207, 209, 211 AND 213 15TH STREET, N.W. <br />(CITY TAX MAP 9, PARCELS 91,92 and 93) <br />WHEREAS, Daniel Veliky, the owner of Parcels 91, 92 and 93 on City Tax <br />Map, has requested an amendment to the special use permit granted by City Council on <br />March 7, 2005 (copy attached), seeking to allow for a density of 87 units per acre in the <br />R-UHD (Residential — University High Density) district instead of 70 units per acre as <br />granted by the March 8, 2005 special use permit; and <br />WHEREAS, the properties which are the subject of this application may be <br />further identified as 201, 203, 205, 207, 209, 211 and 213 15`h Street, N.W., containing <br />collectively approximately 25,564 square feet of land 9 (together, hereinafter "Subject <br />Property"); and <br />WHEREAS, a joint public hearing on this application was held before the City <br />Council and Planning Commission on April 12, 2005, following notice to the public and <br />to adjacent property owners as required by law; and <br />WHEREAS, on April 12, 2005, based on the information presented by <br />Neighborhood Development Services staff as well as by the Applicant, the Planning <br />Commission recommended that the requested amendment be approved as submitted, with <br />all other conditions of the Special Use Permit approved on March 7, 2005 remaining <br />unaffected by this amendment; and <br />WHEREAS, this Council finds and determines that granting the requested <br />amendment to the Special Use Permit would be consistent with the City's Zoning <br />Ordinance and the criteria generally applicable to special use permits under Chapter 34 of <br />the City Code; now, therefore <br />BE IT RESOLVED by the Charlottesville City Council that the Special Use <br />Permit for the Subject Property approved by this Council on March 7, 2005, is hereby <br />amended to increase the maximum density allowed from 70 to 87 dwelling units per acre. <br />All other conditions of the Special Use Permit approved by City Council on March 7, <br />2005 shall remain the same and be unaffected by this amendment. <br />Approved by Council <br />May 2, 2005 <br />C k of City Council <br />C1 <br />
