Approved by City Council on <br />SP -05-01-02 March 7, 2005 <br />eRESOLUTION <br />APPROVING A SPECIAL USE PERMIT <br />FOR ADDITIONAL RESIDENTIAL DENSITY <br />IN CONNECTION WITH THE DEVELOPMENT OF <br />PROPERTY LOCATED AT <br />201, 203, 205, 207, 209, 211 and 213 15"' STREET, N.W. <br />WHEREAS, pursuant to the Code of the City of Charlottesville, sections §34-156 et seq. <br />(Special Use Permits) and §34-420 of the City Code, Mr. Daniel J. Veliky ("Applicant") has requested a <br />special use permit to authorize residential density of approximately seventy (70) dwelling units per acre <br />on property identified on City Tax Map 9 as Parcels 91 (213 15'" Street, N W.), 92 (207 15"' Street, N W.) <br />and 93 (201, 203, 205, 209 and 211 15°i St., N. W.) (together, hereinafter, "Subject Property"). In <br />addition, pursuant to §34-162 and §34-353(D)(2)(ii) of the City Code, the Applicant seeks modifications <br />of (i) the side yard requirements set forth in City Code §34-353(a), and (ii) the parking standards set forth <br />in City Code §34-353(d)(2)(i); and <br />WHEREAS, the Subject Property is zoned "R-UHD" (University High Density District), where, <br />pursuant to §34-420 of the City Code, residential density of 65-87 dwelling units per acre is allowed only <br />by Special Use Permit; and <br />WHEREAS, a joint public hearing on this application was held before the City Council and <br />Planning Commission on February 8, 2005, following notice to the public and to adjacent property <br />owners as required by law; and <br />WHEREAS, on February 8, 2005, based on the information presented by Neighborhood <br />Development Services staff as well as by the Applicant, the Planning Commission recommended that the <br />application be approved as submitted, including (i) reduction of the side yard requirements of §34-353(a) <br />to twelve (12) feet (minimum), and (ii) reduction of the parking requirements of §34-353(d)(2)(i) to one- <br />half (1/2) space per unit; and <br />WHEREAS, this City Council finds and determines that granting the requested Special Use <br />Permit would be consistent with the City's zoning ordinance and the criteria generally applicable to <br />special use permits under Chapter 34 of the City Code; now, therefore, <br />BE IT RESOLVED by the Charlottesville City Council that <br />(1) A special use permit is hereby granted to allow the residential development of the Subject <br />Property at a density of seventy (70) dwelling units per acre, and <br />(2) For the development authorized by this Special Use Permit, the side yard requirements of § 34- <br />353(a) are hereby reduced to twelve (12) feet (minimum), and <br />(3) For the development authorized by this Special Use Permit, the parking requirements of §34- <br />353(d)(2)(i) are reduced to one-half (1/2) space per unit. <br />0 <br />
