• (11) PROGRAMMATIC REVIEW: (a) The Boys & Girls Club shall maintain a written record <br />of all activities and programs occurring on the premises during the term of this lease. Such <br />record shall be in a format similar to the "Commitment to Quality" booklet published by the <br />Boys & Girls Clubs of America, and shall include: <br />(i) a description of the activity or program; <br />(ii) staffing provided for the program; <br />(iii) the starting and ending dates of each program; <br />(iv) the current status of the program; and, <br />(v) the number of participants in each program. <br />Upon request of the City, the Boys & Girls Club will make available for inspection and review <br />the records required by this section. <br />(b) The City also may schedule monitoring visits with the Boys & Girls Club to review the <br />programs provided. The review of records and on-site monitoring visits shall be performed for <br />the City by a representative of the Parks and Recreation Department. <br />(c) Any deficiency in the operation of the programs shall be reported to the Boys & Girls Club in <br />writing by the representative. The City may suspend the use of the premises by the Boys & Girls <br />Club if remedial action is not taken to the address the program deficiencies within a specified <br />time period. Notice of the suspension shall be sent by registered or certified mail to the <br />Executive Director of the Boys & Girls Club. <br />(12) NONDISCRIMINATION: The Boys & Girls Club shall not discriminate on the basis of <br />race, color, sex, sexual orientation, religion, natural origin or disability during their use of the <br />leased premises. <br />(13) ASSIGNMENT AND SUBLETTING: The Boy & Girls Club shall not assign this Lease <br />or sublet any portion of the leased premises without the prior written consent of the City, which <br />consent may be withheld for any reason or for no reason, or which may be conditioned in any <br />way the City chooses.
