RESOLUTION <br />• APPROVING A LEASE TO THE <br />VIRGINIA DISCOVERY MUSEUM <br />FOR CITY PROPERTY LOCATED IN THE 500 BLOCK <br />OF THE DOWNTOWN MALL <br />Whereas, the Virginia Discovery Museum seeks a lease of City -owned property, <br />on which to operate a stationary children's carousel; and <br />Whereas, the proposed lease is the subject of a public hearing conducted on May <br />15, 2006, in accordance with the requirements of Virginia Code §15.2-1800(B); and <br />Whereas, this Council desires to enter into a proposed lease under the terms and <br />conditions set forth following below; <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of <br />Charlottesville, Virginia, that the City Manager is hereby authorized to execute on behalf <br />of the City a written lease document, in a form approved by the City Attorney, containing <br />the following terms and conditions: <br />1. Leased Property: approximately 240 square feet of premises located in the 500 <br />block of the Downtown Mall, opposite the Virginia Discovery Museum; <br />• 2. Lease Term: a period commencing on June 15, 2006 and ending on June 30, <br />2011. <br />3. Rent: the amount of one dollar ($1.00) cash in hand paid; <br />4. Taxes and utilities: payable by Tenant, only if applicable. <br />5. Alterations: Tenant may attach a fence to the Mall, and may take reasonable <br />actions to secure the carousel, related signage, and a security camera to the <br />Property, but shall not make any other alterations to the Property without the <br />prior written approval of the City. <br />6. Maintenance: Tenant shall maintain the carousel, fence and Property in a neat <br />and clean condition at all times. Trash and refuse shall be promptly removed <br />and disposed of by Tenant in a lawful manner. As part of its normal Mall <br />maintenance activities, the Landlord will remove trash, debris, leaves and <br />snow from the space surrounding the carousel, but will not remove such from <br />the carousel itself, and Landlord will maintain the brick located within the <br />Property. <br />7. Surrender of Premises: At the end of the Lease the Tenant shall surrender the <br />• Property and shall restore the Property to its original condition and <br />
