SP -06-3-5 <br />• RESOLUTION <br />APPROVING A SPECIAL USE PERMIT <br />TO ALLOW OPERATION OF A DAY CARE CENTER <br />(INTERNATIONAL SCHOOL OF CHARLOTTESVILLE) <br />AT 830 MONTICELLO AVENUE (BELMONT BAPTIST CHURCH). <br />WHEREAS, The International School of Charlottesville ("Applicant') has requested a special <br />use permit, with respect to property identified on City Tax Map 58 as Parcel 219 (830 Monticello <br />Avenue), consisting of approximately 0.417 acres ("Subject Property"), to allow operation of a day care <br />center in the building known as the Belmont Baptist Church; and <br />WHEREAS, the subject parcel is zoned "R -1S" (Residential — Single Family), where, pursuant <br />to §34-420 of the City Code, day care centers are allowed by Special Use Permit; and <br />WHEREAS, a joint public hearing on this application was held before the City Council and <br />Planning Commission on May 9, 2006, following notice to the public and to adjacent property owners as <br />required by law; and <br />WHEREAS, on May 9, 2006, based on the information presented by Neighborhood <br />Development Services staff as well as by the Applicant, the Planning Commission recommended that the <br />application be approved, with conditions; and <br />WHEREAS, this City Council finds and determines that granting the Special Use Permit would <br />• be consistent with City Code §34-420 and the criteria generally applicable to special use permits under <br />Chapter 34 of the City Code; now, therefore, <br />BE IT RESOLVED by the Charlottesville City Council that The International School of <br />Charlottesville is hereby granted a special use permit to allow operation of a day care center at 830 <br />Monticello Avenue, subject to the following conditions: <br />1. There shall be no more than fifty (50) children enrolled in the International School of <br />Charlottesville, without amendment of the Special Use Permit hereby granted. <br />2. The school shall only be operated between the hours of 7:00 a.m. to 7:00 p.m., Monday through <br />Friday. <br />Approved by Council <br />June 5, 2006 <br />er of City Council <br />
