SP -06-3-5 • RESOLUTION APPROVING A SPECIAL USE PERMIT TO ALLOW OPERATION OF A DAY CARE CENTER (INTERNATIONAL SCHOOL OF CHARLOTTESVILLE) AT 830 MONTICELLO AVENUE (BELMONT BAPTIST CHURCH). WHEREAS, The International School of Charlottesville ("Applicant') has requested a special use permit, with respect to property identified on City Tax Map 58 as Parcel 219 (830 Monticello Avenue), consisting of approximately 0.417 acres ("Subject Property"), to allow operation of a day care center in the building known as the Belmont Baptist Church; and WHEREAS, the subject parcel is zoned "R -1S" (Residential — Single Family), where, pursuant to §34-420 of the City Code, day care centers are allowed by Special Use Permit; and WHEREAS, a joint public hearing on this application was held before the City Council and Planning Commission on May 9, 2006, following notice to the public and to adjacent property owners as required by law; and WHEREAS, on May 9, 2006, based on the information presented by Neighborhood Development Services staff as well as by the Applicant, the Planning Commission recommended that the application be approved, with conditions; and WHEREAS, this City Council finds and determines that granting the Special Use Permit would • be consistent with City Code §34-420 and the criteria generally applicable to special use permits under Chapter 34 of the City Code; now, therefore, BE IT RESOLVED by the Charlottesville City Council that The International School of Charlottesville is hereby granted a special use permit to allow operation of a day care center at 830 Monticello Avenue, subject to the following conditions: 1. There shall be no more than fifty (50) children enrolled in the International School of Charlottesville, without amendment of the Special Use Permit hereby granted. 2. The school shall only be operated between the hours of 7:00 a.m. to 7:00 p.m., Monday through Friday. Approved by Council June 5, 2006 er of City Council
