manning such responding units shall not become employees of the requesting locality for the <br />purposes of the Virginia Workers Compensation Act. <br />is 9. When a responding locality elects to respond to a request for services, the personnel <br />manning such responding units shall remain under the command of the senior officer of the <br />responding locality and shall work as a unified company and shall not be split apart during the <br />emergency operations unless ordered by the senior officer of the responding locality. <br />10. When a responding locality elects to respond to a request for services and the senior <br />officer of the responding locality determines that the emergency operations are being conducted <br />in an unsafe manner, the responding locality may limit its assistance to a support service or <br />withdraw the services to ensure the safety of its personnel. <br />11. This Agreement may be modified only by the mutual written consent of both <br />counties. <br />12. This Agreement maybe terminated at anytime by either locality giving thirty (30) <br />• days written notice of termination to the other locality. <br />13. The parties agree that where it is anticipated an event may result in the declaration <br />of a state or federal emergency, the requesting party shall endeavor to request mutual aid from <br />the responding locality through the Statewide Mutual Aid Program coordinated by the Virginia <br />Department of Emergency Management (the "Program"). Notwithstanding anything to the <br />contrary contained in this Agreement, in the event the requesting locality makes a request for <br />assistance, and receives assistance from the responding locality, through the Program, the <br />relationship between the localities and their respective rights and obligations (including, without <br />limitation, reimbursement of the responding locality by the requesting locality) shall be governed <br />not by this Agreement, but by the policies and procedures of the Program. <br />IN WITNESS WHEREOF, Charlottesville's Mayor and Augusta's Chairman of the <br />• Board of Supervisors execute this Agreement, they being authorized to do so. <br />
