Nothing contained in this Agreement shall in any manner be construed to compel <br />the responding locality to respond to a request for services in the requesting locality when the <br />• resources of the responding locality are needed, or are being used, within the boundaries of the <br />responding locality, nor shall any such request compel the responding locality to continue to <br />provide services in the requesting locality when its resources are needed within the boundaries of <br />the responding locality. <br />3. Each locality acknowledges that it is fully capable of providing fire services, rescue <br />services, hazardous material response services, and other related governmental services to <br />adequately serve its respective locality. <br />Neither locality shall be liable to the other for any loss or damage to property or <br />personal injury or death of personnel resulting from the performance of this Agreement or the <br />failure to respond to any request for services. <br />5. The requesting locality shall indemnify and save harmless the responding locality <br />• from all claims by third parties for property damage or personal injury which may arise out of the <br />activities of the responding locality resulting from the performance of this Agreement. <br />6. The requesting locality shall not be required to reimburse the responding locality for <br />apparatus, equipment or personnel utilized in a response for services, or for damage to such <br />apparatus or equipment, or injuries to personnel incurred when responding in the requesting <br />locality; provided, however, the requesting locality shall reimburse the responding entity from <br />the responding locality the actual cost of specialized extinguishing or hazardous material <br />mitigation agents used in rendering services pursuant to this Agreement. <br />The requesting locality shall make any request for services under this Agreement to <br />the emergency operations center of the responding locality, which will then contact the <br />appropriate officials of the responding locality to determine its response. <br />• 8.
