RESOLUTION GRANTING A SPECIAL USE PERMIT <br />• TO STUDIO HOUSE, LLC <br />TO ALLOW ADDITIONAL BUILDING HEIGHT AND CERTAIN ENCROACHMENTS <br />ON PROPERTY AT 1003 WEST MAIN STREET <br />WHEREAS, Studio House, LLC, owner of the property at 1003 West Main Street (City <br />Tax Map 10, Parcel 51), has requested a special use permit to allow an additional ten (10) feet of <br />building height to a maximum height of seventy (70) feet, and to allow the building's balconies <br />to encroach into the side setback along 10'/z Street, on said property; and <br />WHEREAS, following a joint public hearing before this Council and the Planning <br />Commission, duly advertised and held on August 12, 2008, this Council finds that such use is <br />allowed under City Code Section 34-420, and will conform to the criteria applicable to special <br />permits generally under Chapter 34 of the City Code; now, therefore <br />BE IT RESOLVED by the Council of the City of Charlottesville, Virginia that a special <br />use permit is hereby approved and granted to Studio House, LLC to allow an additional ten (10) <br />feet of building height to a maximum height of seventy (70) feet, and to allow the building's <br />balconies to encroach up to five (5) feet into the side setback along 10% Street, for the <br />development at 1003 West Main Street. This special use permit is conditioned upon: <br />1. Two (2) of the housing units must be offered as affordable housing to persons earning <br />4060% of the Area Median Income; and <br />2. Shade trees must be planted on West Main Street; and <br />3. A secure bike storage facility, separate from the dwelling units, must be provided on-site. <br />Approved by Council <br />September 2, 2008 <br />er of City Council <br />n <br />LJ <br />
