RESOLUTION <br />• APPROVING AN AMENDMENT TO THE SPECIAL USE PERMIT <br />GRANTED TO THE INTERNATIONAL SCHOOL OF CHARLOTTESVILLE, <br />ON NNE 5, 2006 FOR OPERATION OF A DAY CARE CENTER <br />AT 830 MONTICELLO AVENUE. <br />WHEREAS, the International School of Charlottesville ("Applicant") has requested an <br />amendment to the special use permit granted by City Council on June 5, 2006, with respect to property <br />identified on City Tax Map 58 as Parcel 219 (830 Monticello Avenue), consisting of approximately 0.417 <br />acres ("Subject Property"), to allow an increase in the maximum number of children enrolled in the <br />school from 50 children to 99 children; and <br />WHEREAS, at its meeting on June 5, 2006, City Council conditioned approval of the special use <br />permit on a restriction in enrollment to 50 children and the hours of operation to be from 7:00 a.m. to 7:00 <br />p.m., Monday through Friday; and <br />WHEREAS, a joint public hearing on this application was held before the City Council and <br />Planning Commission on May 13, 2008, following notice to the public and to adjacent property owners as <br />required by law; and <br />WHEREAS, on May 13, 2008, based on the information presented by Neighborhood <br />Development Services staff, as well as by the Applicant, the Planning Commission recommended that the <br />application be approved; and <br />• WHEREAS, this City Council finds and determines that granting the amendment to the Special <br />Use Permit would be consistent with City Code §34-156, et seq. and the criteria generally applicable to <br />special use permits under Chapter 34 of the City Code; now, therefore, <br />BE IT RESOLVED by the Charlottesville City Council that the Special Use Permit for the Subject <br />Property approved by this Council on June 5, 2006, is hereby amended to allow an increase in the <br />maximum enrollment from 50 children to 99 children. All other conditions of the Special Use Permit <br />approved by City Council on June 5, 2006 shall remain the same and be unaffected by this amendment. <br />Approved by Council <br />June 16, 2008 <br />CI of City Council <br />
