• RESOLUTION GRANTING A SPECIAL USE PERMIT <br />TO VIRGINIA DELTA UPSILON ALUMNI ASSOCIATION <br />TO ALLOW A FRATERNITY HOUSE AT 135 MADISON LANE. <br />WHEREAS, Virginia Delta Upsilon Alumni Association, Inc., owner of property at 135 <br />Madison Lane, has requested a special use permit with respect to the property identified on City Tax <br />Map 9 as Parcel 148, consisting of approximately 9,996 square feet of land ("Subject Property"), to <br />allow construction and operation of a fraternity house; and <br />WHEREAS, the Subject Property is zoned R-3 Multifamily Residential District, and, <br />pursuant to §34-420 of the City Code, such modifications for use of the property are allowed by <br />Special Use Permit; and <br />WHEREAS, following a joint public hearing before this Council and the Planning <br />Commission, duly advertised and held on May 12, 2009, this Council finds that such use is allowed <br />under City Code Section 34-420, and will conform to the criteria applicable to special permits <br />generally under Chapter 34 of the City Code; now, therefore <br />BE IT RESOLVED by the Council of the City of Charlottesville, Virginia that a special use <br />permit is hereby approved and granted to Virginia Delta Upsilon Alumni Association, Inc. to allow <br />construction and operation of a fraternity house at 135 Madison Lane. Approval of this special use <br />• permit is conditioned upon the following: <br />1. Provision of a bike rack on the Subject Property to accommodate at least four (4) <br />bicycles; <br />2. Provision of an enclosure for trash receptacles, which must be completely <br />screened from view from the street or alley by an enclosure with a minimum <br />height of one foot (1') taller than the trash receptacles; <br />3. Contact information, updated annually, for a local representative of the Applicant <br />shall be provided to the City's property maintenance office. The local <br />representative shall be responsible for addressing property maintenance issues and <br />violations identified by City staff as long as the Special Use Permit is in effect. <br />Approved by Council <br />June 1, 2009 <br />of City Council <br />is <br />
