• SP -09-03-04 <br />RESOLUTION GRANTING A SPECIAL USE PERMIT <br />TO THE PIEDMONT TRIANGLE SOCIETY <br />TO OPERATE A PRIVATE CLUB AT 609 EAST MARKET STREET. <br />WHEREAS, the Piedmont Triangle Society, lessee of commercial building space on <br />property at 609 East Market Street, owned by Townsquare Associates, has requested a special use <br />permit with respect to the property identified on City Tax Map 53 as Parcel 100, consisting of <br />approximately 37,350 square feet ("Subject Property"), to allow operation of a private club; <br />WHEREAS, Townsquare Associates supports the request for a special use permit by the <br />Piedmont Triangle Society to use the leased space as a private club; and <br />WHEREAS, the Subject Property is zoned Downtown Corridor Mixed Use District, and, <br />pursuant to §34-796 of the City Code, such modifications for use of the property are allowed by <br />Special Use Permit; and <br />WHEREAS, following a joint public hearing before this Council and the Planning <br />• Commission, duly advertised and held on April 14, 2009, this Council finds that such use is allowed <br />under City Code Section 34-796, and will conform to the criteria applicable to special permits <br />generally under Chapter 34 of the City Code; now, therefore <br />BE IT RESOLVED by the Council of the City of Charlottesville, Virginia that a special use <br />permit is hereby approved and granted to the Piedmont Triangle Society to allow operation of private <br />club at 609 East Market Street. Approval of this special use permit is conditioned upon the <br />following: <br />1. No source of sound emanating from the club during the hours between 11:00 p.m. <br />and 6:00 a.m. shall exceed seventy-five (75) dB(A), when measured at or outside <br />the property boundary; and <br />2.
