RESOLUTION <br />• REQUESTING THE GENERAL ASSEMBLY TO APPROVE <br />AN AMENDMENT TO SECTION 6 OF THE CHARTER <br />OF THE CITY OF CHARLOTTESVILLE <br />WHEREAS, this Council is of the opinion that it is in the best interests of the citizens <br />of the City of Charlottesville that Section 6 of the Charter of the City of Charlottesville <br />imposing a residency requirement on the Clerk of Council be amended; and <br />WHEREAS, in accordance with the requirements of § 15.2-202 of the Code of <br />Virginia (1950) as amended, on December 7, 2009 this Council conducted a public hearing <br />on the proposed charter amendment, and at least ten (10) days' notice of the time and place <br />of such public hearing, and an informative summary of the proposed charter amendment was <br />published in a newspaper of general circulation in this locality; <br />NOW, THEREFORE, BE IT RESOLVED by the Charlottesville City Council that <br />the General Assembly is hereby requested to approve an amendment to Section 6 of the <br />Charter of the City of Charlottesville, to read as follows: <br />Sec. 6 Officers and clerks elected by council <br />There may be elected by the council such officers and clerks as said <br />council deems proper and necessary, who shall serve at the pleasure of <br />• council, and any one or more of said offices may be held and exercised by the <br />same person. It may be competent for the council, in order to secure the <br />services of a suitable person, to elect nonresidents, but such officer, other than <br />the Clerk of Council, shall reside in the city during his tenure in office. <br />BE IT FURTHER RESOLVED that the Clerk of the City Council shall transmit to <br />the City's legislators a certified copy of this resolution, along with (i) a copy of a newspaper <br />publisher's affidavit showing that the public hearing on this matter was advertised and (ii) a <br />certified copy of the Council minutes showing the action taken at the advertised public <br />hearing. <br />Approved by Council <br />December 7, 2009 <br />A4�-� <br />le c of Council <br />E <br />
